July 29, 2021 Free approval of the Council of Ministers to the mediation proposal on the reform of the criminal trial. As far as we know, there is also the green light for the M5s.



The agreement was found after a river session that underwent a long suspension. Eventually the reform was given the green light unanimously. This was confirmed by the minister for relations with the Parliament Federico D'Incà, responding to reporters on leaving Palazzo Chigi.



The white smoke came after 8 hours of negotiation. The M5s collects the special regime for all mafia crimes, off the grid of non-prosecution.



In detail, the agreement should provide for no timing for crimes attributable to 416 bis and ter, therefore indefinite processes. While for crimes aggravated by the mafia six years of appeal, with a transitional regime between now and 2024. From 2025, the appeal will drop to 5 years.



It is the mediation passed in the Council of Ministers. The proposal, the result of a mediation by the Democratic Party with Minister Orlando, would have absorbed the doubts of the M5s on the impossibility of prosecution for article 416 bis.1 of the criminal code, on the aggravating mafia. An explicit derogation for those crimes would exist in the transitional phase, with the possibility of terms of up to 5 years in full operation.



The times of the classroom


In addition to the hypotheses on the timing of the examination in the Chamber of the reform of the criminal trial - including postponing the general discussion from Friday to Sunday afternoon - the majority also think about the possible ways in which to proceed with the examination of the bill once arrived in the Chamber .



With the achievement of a political agreement between the government and the majority forces, the process in committee could be quite fast, with the examination of only the amendments agreed between the government and the groups and the withdrawal of all other proposed amendments (except for those of the oppositions, over forty FdI and about fifteen Ac).



The Justice Commission could therefore dismiss the provision for the Chamber in a relatively short time. The bill would arrive in the Chamber "armored" by the political agreement.



Once the examination by the Assembly has begun, the government would present an amendment containing the changes already examined by the last CDM. At that point we would return to the committee for a quick step necessary to approve the changes proposed by the government and then back to the Chamber with confidence.
