Mohammed bin Rashid issues a law establishing the "Dubai Academic Health Corporation"

As part of the process of developing the government work system in Dubai with the aim of raising the efficiency of various vital sectors and ensuring the provision of the finest and highest quality services in accordance with the best international standards, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, in his capacity as Ruler of Dubai, issued Law No. (13) for the year 2021 with the establishment of the Dubai Academic Health Corporation, as an academic health system, enjoying legal personality, financial and administrative independence, and the necessary legal capacity to undertake business and actions that ensure the achievement of its objectives. His Highness also issued Law No. (14) of 2021 amending some provisions of Law No. (6) ) for the year 2018 regarding the Dubai Health Authority, as part of the outputs of the government sector development plan approved by His Highness and submitted by the Higher Committee for the Development of the Government Sector headed by His Highness Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler of Dubai and First Deputy Chairman of the Executive Council, in an effort to enhance efficiency and effectiveness sector flexibilitygovernment, in line with the requirements of the current and future stage.


The Dubai Academic Health Corporation aims, in accordance with the new law, to improve health services in Dubai through an academic health system that ensures integration between health care, medical education and scientific research, raises the level of efficiency, quality and accessibility of health services provided in accordance with the best international standards and practices, and enhances sustainability. The services of the health sector in the emirate, in order to achieve the outcomes of the health system, and to contribute to


supporting Dubai’s leadership in academic education and scientific research in the fields of medicine and health sciences, in a way that supports the knowledge economy.

The Foundation also aims to develop, attract and retain medical and research capabilities, promote Emiratisation in various fields of the health sector, and provide a supportive environment for carrying out scientific and clinical research, which advances the health outcomes of individuals and society, as well as contributing to raising the level of readiness and competitiveness of the Emirate in the health sector, by supporting and developing Health care and means of prevention and treatment of diseases and epidemics in accordance with the latest health systems, and strengthening the emirate’s position as a global medical and health center, a destination for health and treatment tourism, and a leading destination in the field of medical education, research


and scientific innovation.

Institution's competencies

According to the law, the institution is specialized in a number of specializations, including: developing and implementing its strategy in line with the strategy of the health sector in Dubai, ensuring the integration of health services, in order to achieve operational efficiency and effectiveness, across the different levels of health care, to ensure the safety and happiness of health service recipients, management, operation and development Governmental health facilities, which include hospitals, primary health care centers, specialized care centers, medical fitness centers, public health and occupational health, either directly or through contracting with others.

The institution is also specialized in providing curative and preventive health services, medical fitness examination services and occupational health examinations in all parts of the emirate, including special development areas, and free zones, including the Dubai International Financial Centre. In accordance with its approved controls and standards, the institution may authorize others to provide some administrative services related to fitness. Medical and occupational health, and the provision of health services to various segments of society at reasonable and appropriate prices in accordance with international health and medical standards.

The law stipulates that the Foundation supports the knowledge economy by promoting research and innovation and attracting investments in health and biotechnology, which contributes to achieving its goals, rehabilitating its health facilities and the services and programs it provides, to obtain international accreditations, and preparing studies for the development of health facilities and new programs , or expanding in the areas of providing various health services and programs, and developing and providing educational and professional programs for health cadres, such as medical education programs, residency programs, and continuing professional development programs, in a way that contributes to developing and strengthening institutional capabilities and competencies necessary to manage health facilities, programs and their affiliated organizational units. Organizing and participating in local and foreign medical events and conferences in coordination with the Dubai Health Authority and the concerned authorities, and promoting


Cooperation and strategic partnerships with government agencies and the private sector to serve the objectives of the institution.

Affiliates of the Foundation

The law stipulates that, as of its entry into force from the date of its publication in the Official Gazette, the following entities will be included in the Foundation: the Dubai Health Care Corporation of the authority, hospitals and its organizational units, in addition to the Mohammed bin Rashid University of Medicine and Health Sciences, Dubai Dental Hospital, and Al Jalila Foundation to support Education and research in the medical fields, Al Jalila Children’s Specialist Hospital, and any other entity that is decided to be included in the institution pursuant to legislation issued by His Highness the Ruler of Dubai. As of the effective date of this law and for a period of six months, the aforementioned entities retain their legal personality under the legislation establishing them or regulating their work, and exercise their tasks and powers entrusted to them under these legislations under the supervision of the institution, provided that these tasks and powers do not conflict with the competences of the institution.During the aforementioned period, the Dubai Health Academic Foundation may seek the assistance of the Executive Authority of the Dubai Health Authority to assist it in providing administrative and technical support services for the institution.


The law also stipulates that the Dubai Academic Health Corporation shall have a


board of directors, consisting of a president, a vice-chairman, and a number of members with experience and expertise in the field of the institution’s work, who are appointed by a decree issued by His Highness the Ruler of Dubai, in addition to an executive director appointed by a decision of the Chairman of the Executive Council For the Emirate of Dubai, based on the recommendation of the Foundation’s Board of Directors.

The law defines the functions of the board of directors and the executive director of the institution, its financial resources, control and audit mechanisms, the issuance of executive decisions, transfer procedures and solutions, and the reconciliation of situations.

Amending some provisions of the Dubai Health Authority Law


and Law No. (14) of 2021 amending some provisions of Law No. (6) of 2018 regarding the Dubai Health Authority, to replace the texts of Articles (2), (5), (6), (9 ), (10), and (11) of the original law, with new texts related to the authority's objectives and terms of reference, in addition to the competencies of the Director General of the Dubai Health Authority, as well as the institutions affiliated to the authority and its executive body.

Objectives of the Authority

In accordance with the new text of the amended Article (5) of the original law, the authority aims to: regulate the health sector to ensure competitiveness, operational efficiency, transparency and quality of services and products in accordance with


approved policies and the highest international standards, organize health insurance programs and services in the emirate for citizens, residents and visitors, and upgrade these programs and services To the highest international standards, developing investment policies in the health sector in Dubai, promoting and supporting innovation, foreseeing the future in all health fields, employing smart technologies, including smart health, enhancing the health and safety of society, protecting it from diseases, epidemics and health risks, and enhancing the emirate’s readiness for emergencies and crises.



Authority's Functions


According to the new amendment, Article (6) stipulates the jurisdiction of the Dubai Health Authority to regulate the health sector in all parts of the emirate, including special development zones, and free zones, including the Dubai International Financial Centre. The authority undertakes all tasks and competencies related to policies, legislation, regulation, licensing and control And the inspection of the health sector, and the authority, on the date of this law becoming effective, replaces the authority of Dubai Medical City in exercising the tasks and competencies stipulated in this law, provided that it has, in order to achieve its goals, the tasks and powers of preparing comprehensive strategic plans related to the health sector in the emirate and supervising their implementation, and preparing And supervising the implementation of the necessary strategies to improve health care services in line with the strategic plan of the Emirate of Dubai, in coordination with the Dubai Academic Health Corporation and the concerned authorities.

The Dubai Health Authority, according to the amended article, is also responsible for conducting studies and research related to the emirate’s need for health and medical services, aligning investment projects in the health sector with the results of these studies and research, developing the requirements for practicing the profession for establishments and individuals, and permitting individuals and government and private establishments to practice the profession in The emirate, as well as monitoring and inspection of health facilities and the professionals working in them, to ensure their compliance with the approved standards, regulations and controls, developing the medical education strategy in Dubai, organizing the provision of medical education services, conducting research and medical experiments in coordination with the concerned authorities inside and outside the country, and preparing and developing investment policies in the health sector in the Emirate of Dubai.



The law stipulates that the Dubai Health Authority shall develop public health programs and policies, including policies for preventive medicine and occupational health and safety services, assess and monitor the health status of the population, develop and follow up the implementation of strategic policies and programs, and research and studies necessary to improve the health status and protect members of society from diseases and health risks. As well as measuring the quality of health care services in the emirate, following up on performance development, submitting periodic reports to the Executive Council of the Emirate of Dubai, regulating and approving the prices of health services in the emirate, in coordination with the concerned authorities, studying and proposing draft legislation regulating the health sector, and making recommendations in this regard to the concerned authorities.

The powers of the Dubai Health Authority, according to the new text, included preparing and developing policies, strategies and legislation related to smart health, working to implement them in coordination with the institution and the concerned authorities in the emirate, organizing the operations of sending patients to obtain health care in health facilities inside and outside the country, and organizing and managing health tourism. In the Emirate in coordination with the concerned authorities.

As well as preparing, managing, developing and implementing policies related to health insurance systems, monitoring and inspection of facilities engaged in any of its related activities in Dubai, establishing a database for the health sector, health care services and patients at the emirate level,


updating and developing it periodically in coordination with the Dubai Academic Health Corporation, managing and organizing And authorizing the media content of health advertisements in the Emirate, monitoring and supervising them, and establishing, managing and operating an integrated health information system in accordance with international health and medical standards, in partnership and cooperation with the Corporation and the private sector.

The authority may entrust the Dubai Healthcare City authority or any public or private entity to carry out any of the powers entrusted to it under the provisions of this law, in accordance with an agreement concluded with it in this regard.


Article (9) of the new law stipulates that the


Dubai

Health Authority shall have a

director general to be appointed by a decree issued by His Highness the Ruler of Dubai, while the article also defines the duties and powers of the director general.

Institutions affiliated with the Authority

According to Article (10) of the law, the Dubai Health Authority shall have within its organizational structure a group of institutions that practice their work in the fields related to the health sector and are affiliated with the authority, and their establishment and defining their terms of reference are issued by a decree of His Highness the Ruler of Dubai, and each of the aforementioned institutions shall have: An executive director is appointed by a decision issued by the Chairman of the Executive Council of the Emirate of Dubai based on the recommendation of the Director General of the Dubai Health Authority.


Articles (7) and (8) of Law No. (6) of 2018 regarding the Dubai Health Authority, as well as any provision in any other legislation to the extent that it contradicts the provisions of this law, shall be repealed.


Law No. 13 of 2021 and Law No. 14 of the same year are published in the Official Gazette, and they come into force from the date of their publication.
