The Second Section of the Provincial Court of

Alicante

has sentenced to sentences of between 14 years and two months and 18 years in prison to the four members of the so-called '

herd of Callosa

' accused of the

gang rape

suffered by a young woman on the day of New Year of 2019 in the Alicante town of Callosa d'en Sarrià.

The sentence, notified to the parties this Friday, declares each of the convicts the author of a continuing crime of sexual assault, due to their direct participation in the facts, and a necessary cooperator of the three crimes of the same criminal type committed by each of the other three co-defendants. Two of them, in addition, the

court

condemns them for a crime of discovery and disclosure of secrets because they

photographed or recorded the events with their mobile phones

, reports the Superior Court of Justice of the Valencian Community (TSJCV).

The judicial resolution considers it proven that the defendants coincided with the victim, then 19 years old, in the leisure area of ​​Benidorm, during the 2018 New Year's Eve celebration, and continued partying with her. In the following hours, they went to a home in

Benidorm

, where the girl was sexually assaulted by two of the men, and to the basement of Callosa's home of one of them, who again sexually assaulted her while the others participated directly or cooperated in some way in that violation.

The victim

"was belittled and reduced to a mere sexual object of the accused"

, who addressed her "with a denigrating spirit" or "in a mocking tone" while the events were taking place, acting "as if it were a festive event, constantly playing music ", or" chistando "in response to their complaints and regrets, according to the sentence.

The Alicante Court appreciates in the conduct of the defendants the mitigating circumstances of

confession and reparation of the damage

, both contemplated in its final conclusions by the Prosecutor's Office and the private prosecution.

In the first place, all the inmates acknowledged the facts during the trial and expressly asked the injured party for forgiveness.

With regard to the second mitigating circumstance, the victim declared feeling compensated by the

compensation of 60,000 euros

consigned in a judicial account by his aggressors before the holding of the oral hearing, the high court explains in a statement.

The mitigation of

drunkenness

is also applied

- which was recognized by the private prosecution but not by the Public Prosecutor - as it is considered proven that the actions of the aggressors were influenced by an "incessant" significant intake of alcohol and narcotic substances.

By individualizing the penalties, the magistrates impose the highest, 18 years in prison, on one of the aggressors, compared to the 21 years and two months requested by the Prosecutor's Office and the 16 years and four months that the private prosecution requested.

The rest of the three defendants have been sentenced to 14 years and two months, 14 years and 10 months, and 17 years and two months in prison, respectively.

All these penalties are accompanied by the corresponding prohibition orders to approach and communicate with the injured party.

Furthermore, the ruling, which may be appealed on appeal, orders the obtaining, even forced, of

DNA evidence of

the four convicted persons for inclusion in a police database, "given the seriousness of the facts and the reiteration of the assault on the victim ".
