• Justice The judge takes the step to try Villarejo and López Madrid for the stabbing of Dr. Pinto

  • Newspaper library order to reopen the 'Pinto case' against López Madrid for harassment

The

Prosecutor's Office

has broken its silence in the

Pinto case

.

And in a forceful way.

Not only does it maintain the accusations that the judge pointed out in his car against the commissioner José Manuel Villarejo, but it also expands those that were pointed out in his day against the businessman Javier López Madrid.

In a letter sent to the

Court of Instruction number 39 of Madrid

, the prosecutor indicates that López Madrid was considered a suspect of a crime of harassment and another of threats, and Villarejo of a crime of injuries with a dangerous instrument.

Now, the Public Ministry accuses both of being investigated of all crimes: "We want it to be expanded in the sense of considering both investigated as co-perpetrators of the aforementioned crimes, by acting in common agreement on the facts committed by each investigated."

Thus, the Prosecutor's Office supports the accusations of Dr.

Elisa Pinto

, who in 2014 denounced harassment, threats and attacks.

He pointed to the commissioner and businessman López Madrid.

In this brief, in which the Prosecutor's Office takes a position against the appeal filed by those investigated against the order to open an abbreviated procedure - a step prior to putting them on the bench - it is argued that the two defendants acted jointly in all criminal actions .

«There are indications that would prove that Javier López Madrid had an agreement with José Villarejo, at that time commissioner attached to the Deputy Operational Directorate, to harass María Elisa Pinto Romero, prevent her from denouncing said businessman, and once he had denounced him for a alleged harassment, make available to him all the necessary police resources to discredit the complainant. In this sense, follow-ups were carried out, unauthorized access to information on Ms. Pinto was carried out, and the police investigation into the events denounced was manipulated by police officers at the service of such spurious private interests, under the superior direction de Villarejo, "says the prosecutor in his letter prior to the indictment.

This newspaper has already denounced several "clear deficiencies" in police investigations.

In the case of the attack, the agents even informed the court that the doctor's vehicle was not seen in the area of the stabbing during the time period in which the stabbing occurred.

However, the videos incorporated into the court case did include the images of Elisa Pinto's car driving through the area with altered driving at the time of the stabbing.

During the investigation, references have appeared in different reports to the relations between Villarejo and López Madrid with police officers directly involved in the investigations and who had at least erroneous statements with the courts.

The Prosecutor's Office details the evidence that it understands exists against both.

Many of them are the result of statements about the stabbing suffered by Dr. Pinto in the presence of her youngest son and others obtained during the searches carried out on the properties of Commissioner Villarejo.

"We are interested in the dismissal of the appeals because there are sufficient evidence in the case to continue the procedure for the alleged crimes of harassment, threats and injuries with a dangerous instrument," he says.

Regarding Villarejo, the prosecutor details that "there are indications of his participation in the injuries suffered by Elisa Pinto." It explains that the doctor's wounds and her injuries on April 10, 2014 were caused by "a knife, which was immediately assisted by CNP agents 96537 and 107691, later by the

Samur,

and subsequent emergency assistance." It adds that the attack was corroborated "by the judicial statement made by the minor son of the injured party who suddenly" heard a voice and said (to his mother) 'López Madrid wants you to close your mouth' and his mother had her back turned and a man in front of her and he began to scream, "says the letter to which

EL MUNDO

has had access

.

The defendants have always maintained that this attack had not occurred.

The police investigators even issued a report (which was dismantled by the defense of the doctor) in which they doubted the attack because the doctor's vehicle where he was attacked was not picked up on the date and time of the attack by the cameras. safety.

However, the cameras did record the vehicle in the area and this is shown in the videos that are involved in the case and that the investigators did not include in their report.

The prosecutor denounces in his letter the possibility of "police manipulation" of the investigations.

It indicates that members of the Police have "manipulated" the investigation

The prosecutor also refers to the recognition round that was held, despite the obstacles that the police tried to put up, and in which the doctor identified Villarejo as the person who stabbed him.

The prosecutor collects data from the agendas intervened in Villarejo and that are in the hands of the National Court in the framework of the

Tandem operation

.

In an annotation, the same commissioner points out on May 17, 2017: "Try to delay the wheel in any case, you have to prepare the statement once I identify myself, because it will be like that."

Villarejo tried to avoid the recognition round where the doctor identified him as the alleged aggressor.

Likewise, it cites recordings intervened by the commissioner in the records and that, from the National High Court, were included in a separate piece.

José Manuel Villarejo, during an appearance in the 'Kitchen commission' of Congress.POOL

"Chiquitín, damages and losses"

"They continue to speak of a 'war' that Villarejo says that the Troll has been invented [nickname that refers to the former head of the CNI, General

Félix Sanz Roldán

]. Villarejo comments that the one he is mounting is for fear that he put in prison for the issue of

little Nicolás

and 'for the Pinto' ".

It also includes a conversation dated January 25, 2017 recorded in a bar:

Villarejo: Yes ... Tronca del Gordillo, that cocksucker, who is our colleague ... Yes, yes, well now he's a lawyer.

That he was also the woman's lawyer, the doctor that I stabbed ...

Javier: I didn't know ...

Villarejo: Yes, yes ...

Javier: But if that man (unintelligible)

Adrián: What I don't understand is why you failed (laughs Villarejo)

Villarejo: Because there I was nervous.

Alberto: That's 2 centimeters ...

Villarejo: (Laughing) Because I was nervous, it will be a bitch ...

And another conversation dated January 26, 2017, in which Villarejo acknowledges that he will claim "from his client a payment for compensation for his performance in the private conflict between Elisa Pinto and the aforementioned Javier López Madrid."

Villarejo: When I finish everything, when I put the complaint to the kettle, this one and all those who have helped him and such and such, I will talk to him, with Javierito put a little money, because you have put me in a "ball" and nor have you called me to tell me ...

Villarejo: I'm going to tell you, little boy, damages ".

The prosecutor recalls that these recordings are in a piece originated by the Anticorruption Prosecutor's Office on December 20, 2019 "for the investigation of a bribery crime in which Javier López Madrid, José Manuel Villarejo and

Rafael Redondo

would be authors

."

The prosecutor claims that "Elisa Pinto is considered an injured party" in this piece.

Recognition wheel

It also points out that on December 10, 2013, Javier López Madrid attended the professional office of Elisa Pinto with Rafael Redondo, "partner and collaborator of José Villarejo." "This conversation is recorded, which together with the annotations in the aforementioned agenda of the investigated Villarejo, it seems clear the existence of at least one commission whose specific object is unknown, but in which it seems incidentally verified that the investigated at least was interested in investigations followed by the

Homicide Group

, particularly due to the direct reference to the foreseeable result of the recognition round, "concludes the prosecutor.

As for the businessman Javier López Madrid, the prosecutor concludes that "there are indications that would prove that he had an agreement with Villarejo, at that time Commissioner attached to the

Deputy Operational Directorate

to harass María Elisa Pinto Romero, prevent her from reporting said businessman, and a Once he had denounced her for alleged harassment, make available to him all the necessary police resources to discredit the complainant. In this sense, follow-ups were carried out, unauthorized access to information on Ms. Pinto was carried out, and he allegedly manipulated the police investigation into the events denounced through police officers at the service of such spurious private interests, under the superior direction of Villarejo. "

The representative of the Public Ministry understands that the indications are in part coincident with those previously outlined for the other investigated: statements by Elisa Pinto and her son, material from the entry and search of Villarejo's home (recordings, annotations).

It points out that in a police communication the Central Investigating Court 6 was informed that among the documentation intervened in the case records, different documentation related to the judicial procedure being processed before the Investigating Court 39 of Madrid had been found and that included " documents related to the procedure itself, informative notes, press articles, audio files in which María Elisa Pinto Romero and third parties intervene, as well as Javier López Madrid and Rafael Redondo, among others ".

As a result of this investigation, it has been corroborated that "the criminal activity carried out by Villarejo, guided by the immediate and unscrupulous satisfaction of a personal desire for profit, cannot be considered occasional or purely individual," concludes the prosecutor.
