• Granada Juana Rivas, third grade in record time

  • Report The judge believes that Juana Rivas is not "especially deserving" of pardon because she has not repented

Hard report from the Prosecutor's Office against the pardon requested by Juana Rivas, the mother of the Granada town of Maracena who eloped with her children in 2017 and kept them away from their father for 14 months. For this conduct, she was sentenced by the Supreme Court to two and a half years in prison for child abduction and to compensate her former partner

Francesco Arcuri

with 12,000 euros. She was also disqualified from exercising parental authority over her children for six years.

EL MUNDO had access to the report of the Prosecutor's Office, dated June 30, in which it is censured how Juana Rivas

"deliberately violated our

internal

legislation

" and made "mockery of the international commitments signed by Spain", by fleeing and Refusing to hand over, as ordered by the judges, his two sons to the father, who resides in Italy.

For this reason, the representative of the Public Ministry

opposes

the Government granting this mother the

measure of grace

and attacks the

"obvious contradictions"

of Juana Rivas, by asking for a pardon and wielding an alleged repentance, while proclaiming " to the four winds that I would do it again.

This "incoherence, if not a

complete absurdity

" denotes, for the prosecutor, a "paradox similar to that scientifically known as '

Schrödinger's cat

', a hypothetical cat that can be simultaneously alive and dead, in a state known as quantum superposition , as a result of being linked to a random subatomic event that may or may not occur ”, states prosecutor

Valentín Ruiz

.

The requested measure of grace must be rejected - in the prosecutor's opinion - because the requirements of

"justice, equity and public utility"

, which Juana Rivas wields,

are not met

.

"Such considerations have become commonplace when discussing incidental issues relating to the sentence for which forgiveness is sought," he adds.

The prosecutor recalls how Juana Rivas was in

"frank rebellion"

and promoted "unsuccessful incidents, unduly delaying the execution" of what was ordered by the judges for the children to return to Italy with their father, where the family lived for several years. "And when he had to respond criminally to what happened, after deliberately violating our internal legislation and making a mockery of the international commitments signed by Spain, [Juana Rivas] excused or pretended her

pain as a suffered battered mother

, accompanied by the media uproar," he adds the representative of the Public Ministry.

The judge who tried Juana Rivas has also opposed the pardon in a letter dated July 1, in which he recalls that he has not repented and "

it is not real

that his criminal conduct", when he eloped with his children and evaded the judicial decisions that forced her to return them to her father, "came motivated by the desire to protect her children from an

abusive father

," says the head of the Criminal Court 1 of Granada.

"There is no evidence of that

infernal

mistreatment

environment

at all because there has not been a single sentence after the moment in which the coexistence with the father of the minors begins," says the judge.

As this newspaper has been reporting, Juana Rivas is already serving a sentence in her own home, with telematic control, after achieving the third degree in record time.

Maracena's mother was only deprived of liberty for four days and four nights at the Matilde Cantos Center for Social Insertion (CIS) in Granada.
