“Employees have the right to decide whether to vaccinate or not, but if they do not vaccinate, they will be suspended from work without pay.

An exception is the category of employees who cannot be vaccinated for medical reasons, they should also be dismissed, but with the preservation of two-thirds of their earnings, ”the lawyer said.

At the same time, the provision of a fake vaccination certificate may become the basis for initiating a criminal case, he recalled.

“But, I want to emphasize that in this situation, the“ left ”certificate of the presence of contraindications constitutes a criminal offense, since it is a document that gives rights and releases from obligations,” Barshchevsky emphasized.

As Labor Minister Anton Kotyakov said earlier, an employee who, without objective reasons, did not receive the mandatory vaccination against COVID-19 during the epidemic, may be suspended from work without pay.

At the same time, he recalled that the Labor Code does not provide for the possibility of dismissal for refusing to vaccinate.
