Judges in the federal courts called on lawyers to adhere to the rituals of remote sessions, starting with wearing the lawyer’s official uniform, prior mental preparation, and not attending sessions while driving.

In a report issued by the Ministry of Justice on the advantages of the smart justice system, Judge Jamal Al-Senussi of the General Chamber of the Sharjah Federal Court of First Instance confirmed that the system is available for use from anywhere, but the rituals of the court session must be preserved.

He talked about the many advantages that the smart justice system provides, in terms of shortening time and effort, whether on judges or parties to cases, as well as its reflection on the speed of achievement and the achievement of impartial justice.

With regard to the publicity of the sessions, he said that it is an important and legally determined thing, and under the smart justice system, part of this publicity is achieved by making the system available to all parties, litigants and lawyers, to attend on the day set for their sessions throughout the day and for all sessions.

For her part, the head of the second partial circuit, Judge Dr. Salama Rashid Al-Ketbi, suggested, in the report published by the "Justice" magazine issued by the Ministry of Justice, expanding the judges' powers to view all case files and not only those they are looking into, considering that this would be very useful in broadening their perceptions. The judge and increase his legal culture, without giving him the power to make decisions in those cases.

Al-Ketbi suggested that the powers granted to the judge continue to consider his cases during his leave, whether sick or normal, in coordination with the alternative judge, in order to ensure continued access to the course of the case, and she believes that this would be better than removing his powers completely during the leave period.

She noted the advantages of the smart justice system, saying that "classifying and naming papers in electronic case files (expert report - memorandum submitted by the plaintiff or defendant - receipts or invoices - official document ... etc.) is an important step that facilitated a lot for us and saved time and effort."

She pointed to the large bag that she used in the past to carry heavy case files from home to office and vice versa daily, saying that it has become a thing of the past, and that today it only carries a tablet computer.

The Ministry of Justice stated that it began several years ago a journey of converting its services to electronic and smart services, and this shift included, in the beginning, electronic registration services, calculating fees, access to the session schedule and search engines for lawyers, notaries and others, and today it was able to get rid of paperwork completely. And transfer all its procedures related to the registration of lawsuits, judicial requests and requests for execution at the level of the federal courts in the country, to electronic systems at 100%.

The head of the Sharjah Federal Court of First Instance, Judge Dr. Muhammad Obaid Al Kaabi, said that

The ministry allowed university students in law faculties, and trained lawyers, to attend the sessions, except of course for the sessions of personal status and inheritance issues due to their privacy, adding that the litigants can, when the court considers their cases, submit all the requests they wish to submit during the course of the case through the electronic system and during the course of the case without need They come to court.

Al-Kaabi confirmed that the ministry is continuing to develop the system and listen to all the observations of customers and lawyers and make improvements and amendments to ensure the continuity and smooth operation of the system. Intelligent justice.

For his part, the President of the Total Civil Commercial Court, Judge Hossam Al-Hamour, said that “the smart justice system allowed the parties to the case and lawyers to enter the system and submit applications at any time, even if they were on official holidays, without attending the court themselves, and we as judges must We look at it around the clock and this achieves a kind of speed of completion for the dealers, although it is a burden on us, as we will at all times become mentally connected with the system and at any time we look if there are new requests, but at the same time it achieves fast justice and reduces the burden the trouble of litigants, and it is supported by the justice system in the state.”

Lawyer Muhammad Ali, from Al-Afaq Law Firm, said, “The smart justice system has achieved many facilities, and shortened time and effort for us as lawyers, whether in registering or filing cases or submitting requests and responding to them, as well as speeding up procedures in the implementation departments. He stressed that the development of smart justice programs must be continuous, and that listening to the observations of lawyers and judges is very important in terms of the practical application of the electronic system, and in order to speed up the steps in its development.

Legal enforcement issues

Lawyer Hamid Mubarak Al-Ghafli suggested, with regard to legal enforcement cases, that there should be a unified link for lawyers as is the case in civil cases, pointing out that privacy may be less when reaching the implementation stage in Sharia cases from his point of view, and therefore lawyers can attend the sessions openly.
