Cartabia: reduce trial duration


"The fundamental role of civil justice is to protect the daily needs of citizens as well as those of economic operators: we are committed with the European institutions to reduce the duration of trials by 40% in 5 years. approval of this, like the other upcoming reforms concerning justice, depends on the disbursement of the funds provided for by the NRP, to contribute to the overall revitalization of the country and its economy ".



This was declared by the Minister of Justice Marta Cartabia, after the deposit of the Government amendments to the bill for the reform of the civil process. For the Keeper of the Seals, the reform is hinges on two points: "to make the justice response in the courts more immediate and secure and, an aspect that is anything but secondary, to stimulate a culture of consensual settlement of conflicts, counteracting excesses of litigation. they enhance the alternative dispute resolution tools with important tax incentives ", explained Cartabia.



The amendments presented by the Government are in total 24 and aim at a reform that simplifies civil proceedings in the forms and times, provides faster answers to the daily needs of citizens, and favors the attraction of foreign investments. The supporting architecture of the civil justice reform - underlines via Arenula - revolves around the commitments undertaken by the Government with Europe in the NRP, and, without upsetting the existing system, aims to rationalize some crucial junctions.



Among the main innovations, the enhancement of alternative forms of justice, the simplification of civil proceedings (also stabilizing the telematic innovations introduced during the Covid emergency), the strengthening of credit protection in the executive process, a simplification for judgments on work, the institution of a unitary rite in place of the fragmentation of family proceedings, while preserving the specificities of juvenile justice. The spirit of the reform, therefore, lies in the idea of ​​an "agile" process, under the banner of "collaboration between the parties", the defenders and the judge.
