The Superior Court of Justice of Catalonia (TSJC) orders the Interuniversitari Council of Catalonia, which depends on the Department of Research and Universities of the Generalitat, to distribute to the students the statements of the selectivity exam that begins this Tuesday in Catalan, Spanish or Aranese according to the student's choice. In this way they have estimated the very precautionary measure presented by the Assembly by a Bilingual School of Catalonia (AEB) that considered that the Generalitat violated the constitutional rights of non-discrimination and education of the 40,000 Catalan students enrolled in this university entrance exam at the urge the teachers to distribute the exercises in Catalan and only in the event that a student requests it, can they give him / her a copy of the exam in Spanish.

Among the norms of the Interuniversitari Consell de Catalunya for the members of the selectivity courts, it was urged "to first distribute the exam statements in Catalan and, only if a student requests it, give them the Spanish version and retrieve the Catalan version. For statistical purposes, it is necessary to state in a report how many are fought, in Spanish, without identifying the students ". In its precautionary resolution, the TSJC suspends this rule and recalls that "the choice of the language of the examination statements cannot be determined by the Administration and, instead, they must be available in the three co-official languages ​​and will be offered individually to the student the option to choose them in the official language that he / she considers ". That is why it requires the "President and the secretary of the Interuniversity Council of Catalonia, by means of the notification of this resolution, in order to have what is necessary for the execution of the agreement ".

The AEB requested that "the exams be printed in the three languages ​​and that the student in the teachers' distribution have them available", since the exams cannot be changed in less than 24 hours. However, they believe that for the September evaluation they could be printed with the statements in Catalan, Spanish or Aranese. Specifically, they point out that the priority distribution of exams in Catalan is contrary to the principle of non-discrimination and the right to education, since these tests are decisive for the academic future of students and must therefore be carried out under equal conditions, without that no type of discrimination can influence its result.

"The misinformation about the possibility of choosing the exam in either of the two languages, the necessary express request and the counting of the number of exams delivered in Spanish, are intended to hinder the student from choosing this language to answer. It is a clear discrimination based on reason of language that the Interuniversity Council of Catalonia establishes, only for identity reasons, a preponderance of Catalan over Spanish, which clearly harms students who want to develop the exercises in Spanish or Aranese ", indicated the entity.
