Subcontracting threshold The subcontracting threshold rises


to 50% until 31 October 2021, in the draft of the recovery decree entering the council of ministers. This is what is learned from various government sources. The text has yet to be discussed in the CDM and therefore changes are not excluded. However, this would be a "transitional phase". A "necessary requirement" for companies taking part in the recovery plan tenders is the obligation to take on a quota, not less than 30%, of young people under 36 and women.



Guarantees to strengthen construction site safety


The subcontracting threshold rises, but with particular guarantees. The procurement contract, reads the draft of the Recovery dl, "cannot be sold", as well as the entire or "prevailing" execution of the works. The subcontractor must guarantee the same quality standards provided for in the contract and pay workers the same economic and regulatory treatment that the main contractor would have guaranteed, including the national collective agreement. The contracting authorities must also ensure "a more intense" protection of work and the health and safety of workers and "prevent risk.



Very articulated decree


The draft of the Recovery decree in entry to the council of ministers this evening is 68 articles. The text incorporates the rules on the governance of the NRP and those on simplifications, from the acceleration of procedures to waste treatment. A revision of the rules on subcontracting is also envisaged with a new threshold of 50% and with detailed guarantees in favor of workers and their safety. On the other hand, the norm for the 350 recruitments inserted in the previous versions of the text does not appear. 



Superbonus hotels


The extension of the superbonus to hotels is skipped: according to what is learned from various sources, the measure, which appeared in the latest drafts of the Recovery decree, was removed from the draft entering the Council of Ministers and should not find a place in the final version of the provision with simplifications and governance for the recovery and resilience plan. Instead, there is an extension to nursing homes, hospitals, outpatient clinics but also colleges, hospices and barracks.



Workers


The trade unions would have put forward their proposals, which would aim at guaranteeing subcontracted workers the same conditions as the national collective agreement applied to employees of contractors and excluding that the economic and regulatory treatment of workers could be elements on which to play in the proposals for tenders.   



The prevailing hypothesis was still that of extending the threshold to 40%, already envisaged by the simplification decree of 2020, but with specific constraints for employers. Another issue hanging in the balance until the last would be that of the extension of the Superbonus to hotels: the rule would still appear in the draft discussed in the pre-Council, but doubts remain, also for the costs of the measure.



Green pass


The national-DGC (Digital Green Certificate) platform for the issue, issue and verification of Covid-19 interoperable certifications at national and European level is created through the infrastructure of the Health Card System and managed by the same on behalf of the Ministry of health, the data controller of the data generated by the platform itself. This is what is stated in the draft of the Recovery decree.
