Munich (dpa / lby) - The mask requirement for MPs also at their seats in the plenary hall and the test arrangement for parliamentarians who are exempt from the obligation remain in force.

The Bavarian Constitutional Court rejected an urgent application from the AfD parliamentary group in Munich on Friday, which aimed to suspend the extended corona protective measures (file number Vf. 37-IVa-21).

"In part, the application is inadmissible," says the court's press release. In addition, the disputed measures would “at least not obviously” infringe the rights of the applicants concerned. In addition to the AfD parliamentary group itself, its chairman Katrin Ebner-Steiner, the parliamentary managing director Christoph Maier and the two MPs Franz Bergmüller and Markus Bayerbach are applicants.

The President of the Landtag, Ilse Aigner (CSU), was confirmed in her line by the decision of the Constitutional Court: "The clear rejection of the urgent application by the AfD makes it clear that the extended protection and hygiene measures in the Bavarian Landtag in no way affect the exercise of the free mandate of MPs." she said at the request of the dpa.

It is legitimate to wear a mask at the seat, and so is access to meetings without a mask only for those who have tested negatively.

"MPs protect themselves and others, the functionality of the Bavarian State Parliament is guaranteed even in the pandemic."

The Constitutional Court had already rejected an urgent application from the AfD parliamentary group in a procedure on September 14, 2020 (Vf. 70-IVa-20).

The case concerned the regulations for wearing a mouth and nose cover in the Maximilianeum as well as the minimum distance requirement and the maximum occupancy capacity of the meeting rooms.

However, the main proceedings are still pending in this proceeding.

Aigner emphasized that she was optimistic about the main proceedings.
