The Court of Appeal now finds that the 14-year-old who stabbed a 17-year-old in Huskvarna was not guilty of manslaughter, aggravated assault or causing another person's death.

At an earlier stage after the district court's ruling, the 14-year-old owed the 17-year-old's relatives several hundred thousand kronor.

But now he is also released from liability for damages.

Chopped in the abdomen

The Court of Appeal, like the district court, has concluded that the 14-year-old caused the 17-year-old's death by stabbing him in the abdomen with a knife.

Unlike the district court, however, the Court of Appeal has considered that the 14-year-old's mental condition has been so serious that he was unable to adapt his actions to what was permitted under the emergency defense court.

The Court of Appeal refers to a provision which means that a person who has done more than what the emergency defense court allows should still not be liable for a crime if the situation has been such that he "could hardly recover".

Come suddenly

The Court of Appeal further states that the 17-year-old's knife attack on the 14-year-old's friend came suddenly and that it was all about a short course of events.

Therefore, there was no time for the 14-year-old to think about how he would act during the situation.

At the same time, it has previously emerged that the 14-year-old was very scared during the fight and thought that his friend would be killed.

The Court of Appeal also believes that the 14-year-old is so young that he cannot be considered to have fully developed judgment and impulse control.
