The law stipulates that a maximum fine of 10,000 yuan (RMB, the same below) can be fined for merchants to induce misleading consumers to order meals; food producers and operators can be fined up to 50,000 yuan for serious waste; produce and publish overeating video programs, The maximum fine is 100,000 yuan.

  There are 32 articles in the law, which respectively stipulate definitions, principles and requirements for anti-food waste, responsibilities of the government and departments, responsibilities of various entities, incentive and restraint measures, and legal responsibilities.

At the same time, the law establishes a long-term mechanism in five aspects.

  One is the working mechanism.

People's governments at all levels are required to determine the goals and tasks of anti-food waste, establish and improve the anti-food waste working mechanism, and organize the monitoring, investigation, analysis and evaluation of food waste.

It is stipulated that the development and reform department of the State Council and relevant departments of the State Council will analyze and assess the situation of food waste every year, deploy anti-food waste work as a whole, and put forward relevant work measures and opinions.

  The second is the open mechanism.

Local people's governments at or above the county level are required to publicize the anti-food waste situation to the public every year, and propose measures to strengthen anti-food waste.

It is clarified that food and catering industry associations will announce to the public the anti-food waste situation and the results of monitoring and evaluation every year.

  The third is the supervision mechanism.

It is clear that people's governments at all levels and their relevant departments shall establish anti-food waste supervision and inspection mechanisms, and adopt measures such as notification, interviews, rectification, and reporting to strengthen supervision and management.

Require schools to establish a supervision and inspection mechanism to prevent food waste.

The food and catering industry associations are required to strengthen industry self-discipline, and take necessary self-discipline measures against members who engage in wasteful behavior.

It is clear that the news media shall supervise the behavior of food waste by public opinion, report advanced models, and expose the phenomenon of waste.

  The fourth is the incentive mechanism.

People's governments at or above the county level are required to support scientific research and technological development activities to prevent food waste.

Make it clear that the country implements tax policies that are conducive to preventing food waste.

Catering service operators can reward consumers who participate in the "CD Action".

  Fifth is the mechanism of co-governance.

Clarify the responsibilities of the government and departments, set up various main responsibilities reasonably, give full play to the role of industry associations, effectively promote publicity and education, and build an anti-food waste social co-governance mechanism featuring government leadership, departmental collaboration, industry guidance, media supervision, and public participation.

  The law also specifically clarifies that meals for official activities shall not exceed the prescribed standards, and food waste disposal fees may be charged for food waste.
