April 26, 2021 The prosecutor of Siena, regarding the investigation into the accident in which Alex Zanardi was seriously injured in Pienza on June 19, asked the investigating judge to dismiss the accusation of negligent injury against the only suspect. the driver of the truck against which the handbike champion collided. 



The prosecutor of Siena, it is explained in a note released by the same judicial office of the Tuscan city, asked for the filing "not recognizing any causal link between the conduct of the driver driving the articulated lorry and the determination of the road accident".



"According to the prosecutor's office, the driver of the truck - we read again - was traveling at a moderate speed and in any case well below the speed limit set on that stretch of road". According to the investigators, the truck driver "reacted promptly to the sight of the cyclist by implementing an emergency maneuver (steering towards the right edge of the carriageway) to move away from the centerline and try to avoid the impact with the handbike driven by Zanardi, impact which unfortunately occurred entirely within the lane pertaining to the articulated lorry ".   



In the aforementioned dynamic - according to the prosecutor's office - the position of the articulated lorry on the carriageway had no causal effect and in particular the circumstance that shortly before the impact, in dealing with the curve to the left, the truck driver had moved closer to the center line, trampling it halfway with the front left wheels and passing it by a few centimeters with the rear ones with consequent exclusion of culpable criminal responsibility for the suspect ".



The lawyers of the sample oppose archiving


Zanardi's lawyers filed an objection to the filing "attributing causal effect to the conduct of the driver of the vehicle" and arguing that "the partial crossing of the centerline caused Zanardi to steer to the right, resulting in the loss of control of the vehicle ". This is what is read in the same note released by the Siena prosecutor's office which concludes by explaining that "the file was sent to the investigating judge for the determination of jurisdiction".
