Cologne (dpa) - An employee complies with the mandatory quarantine and gets dismissed for it - that doesn't work, the Cologne Labor Court ruled.

According to a statement on Wednesday, the court declared the termination to be ineffective.

The employee had received an order from the health department last October to stay at home.

His girlfriend's brother had tested positive.

He informed his employer, a small roofing company, about this.

But the boss suspected that the man just wanted to avoid work.

He asked for written confirmation from the health department, and when it still wasn't available a few days later, the dismissal followed.

The court regards this as "immoral and unfaithful".

The employee merely adhered to the official quarantine order.

To make matters worse, the employer had expressly requested the employee to appear in the company contrary to the quarantine instruction.

An appeal can be lodged with the Cologne Regional Labor Court against the judgment.
