For this reason, the Court of Cassation, according to verdict 14862, denied Edson Tavares - the 33-year-old sentenced to 15 years, 5 months and 15 days in prison for having scarred the former Gessica Notaro - the granting of extenuating circumstances.

In the case of Gessica Notaro, the new law did not apply as the attack she suffered on the evening of January 10, 2017 in the condominium of her home in Rimini, took place before the new law. All his story - however - has been considered in its gravity and, the Supreme Court notes, the choice to "introduce and challenge the accused the further very serious crime of injury in the trial for stalking is therefore" logical, inserting this fact into the sequence of the persecutory activity of Tavares against the Notaro, without any 'duplicatory' value, which cannot be hypothesized, however, in consideration of the fully legitimate meeting of the trials on appeal ".



Thus the supreme judges responded to defensive objections aimed at arguing that Tavares had been tried twice for the same fact. In addition, the Supreme Court has fully given credit to the depositions of Gessica Notaro - who recently found a smile again thanks to the umpteenth operation - "not animated by slanderous or vindictive intent" towards Tavares so much so that the girl "never induced to sue or denounce the accused 'in order not to ruin him "and this despite the fact that he" forced her to lead a limited, anguished and "armored" life, except for the rare moments of exasperation triggered by his contradictory and selfish behavior ".



In the verdict, the Supreme Court recalls that starting from May 2016 - after the relationship between the two was over and Gessica did not intend to reconnect it - and then in crescendo until August 2016, when Tavares is first hit by a warning and then by the ban. of approaching the victim and not going out at night, the threatening messages he sends to the girl become more and more "alarming and vindictive".



The circumstance that Gessica sought for fear of worse consequences of "not further exasperating the accused in his manifestations of anger and anger" by showing on some occasions a compassionate attitude "certainly does not indicate - explains the verdict - that the behavior had ceased However, this "solidarity" attitude sometimes adopted by the Notaro "in order not to exacerbate" the violent acts of the former partner "did not help prevent the precipitate of events with the acid attack".
