Potsdam / Berlin (dpa / bb) - An urgent application by a student against compulsory testing at schools in Brandenburg was unsuccessful in court.

The Higher Administrative Court of Berlin-Brandenburg (OVG) refused to provisionally suspend the measure in the state's current containment ordinance.

The regulation stipulates that, from next Monday, access to schools and thus participation in face-to-face classes is only permitted after a negative corona test has been submitted, provided the schools have a sufficient number of test options.

The student justified his application by stating that this regulation in the Infection Protection Act did not find a sufficient basis.

In support of its decision, the court said on Wednesday that, with a view to the current pandemic in Germany, everything speaks for the fact that the protection of the life and health of a large number of people justifies this encroachment on the general freedom of action.

The unequal treatment between tested and untested students is justified by an objective reason, because the combination of face-to-face teaching with the submission of a current negative test result helps to contain the pandemic.
