Weilheim (dpa / lby) - A family court in Weilheim in Upper Bavaria has exempted a child from the mask requirement in his school.

In the ruling, the family court ordered on Tuesday that the school management was no longer allowed to require the child to wear a mouth and nose cover on the school premises.

As a spokeswoman for the court announced, the decision only applies to this individual case (Az. 2 F 192/21).

The online platform "Tichys Insight" had previously reported.

The child's parents had sued in Weilheim.

The proceedings were brought before a family judge who had to decide whether the masks could endanger the child's welfare.

The court saw this as given by the Corona regulations applicable at the secondary school.

The judge also referred to Professor Christof Kuhbandner from the University of Regensburg.

The psychologist had already pointed out possible negative side effects for students in the past.

The Weilheim district court also decided that the child at the secondary school should not be isolated in class because of the ruling.

In principle, however, the court decision does not overturn the relevant ordinance.

Because the district court would not be responsible for such a legal review, but the administrative courts.

In Weimar, Thuringia, the family court had already ruled against the mask requirement at two schools.

The Thuringian Ministry of Education then reported "serious procedural doubts" about the decision.

The AfD in the Bavarian state parliament, on the other hand, called on the state government in Munich to change the regulations because they had "long since proven to be nonsensical and harmful".
