Darmstadt (dpa / lhe) - A father is said to have left his eleven-year-old son in the cold for two hours at night after a dispute over homework in December 2019 in Alsbach-Hähnlein in southern Hesse.
In the first instance, the Darmstadt District Court sentenced the 53-year-old to one year suspended prison sentence at the end of 2020.
The court assessed the act as a violation of the duty of care.
Now the case will be heard on Friday (9:00 a.m.) in the second instance before the Darmstadt Regional Court.
The defense had pleaded for acquittal in the first trial because the boy would only have had to walk 400 meters home.
The public prosecutor's office and defense had appealed against the judgment of the district court.
