  School violence and bullying have always been unsolved problems in South Korea, and a series of related scandals have been exposed and aroused public debate.

  According to a school violence survey released by South Korea on March 26, out of 5,244 adult male and female respondents, 1 in 4 (24.3%) said that “I have suffered campus bullying”.

In the survey, 87.3% of people said that campus bullying caused them mental losses, and 55.2% said that they had suffered physical losses.

Victims have difficulty talking during school

It is difficult for the offenders to be punished after graduation

  However, the survey found that the more frightening point is that more than half (51.1%) of the interviewees said that they did not tell people around or ask for help about the bullying.

  In addition, 89.2% of people think that the problem of school violence in South Korea is very serious. At the same time, 7 out of 10 people pointed out that "the punishment system is lax."

  Many people who have suffered bullying on campus say that they fail to report the situation to others or seek help in a timely manner.

They are afraid of being known by their classmates, or think that the teachers' handling methods are not helpful, and some shrink back because they think that the perpetrators will get worse when they are punished.

  However, recently many victims of school bullying in South Korea have gone to receive legal advice.

Although they have graduated a long time ago, they said they wanted to use legal means to find “justice” for the injuries suffered in those years.

However, the judiciary generally believes that "if you have graduated, it is actually difficult to punish the perpetrator."

  South Korea’s "Joongang Daily" reported that group isolation is one of the typical campus bullying behaviors in South Korea. However, if the perpetrators did not inflict physical or verbal violence, as there are no relevant penalties in the criminal law, this type of bullying behavior is general. In other words, it will not become the target of criminal punishment.

According to South Korea's "School Bullying Prevention and Countermeasures Law", group isolation belongs to campus bullying.

From the perspective of the scope of punishment, the scope of punishment of the Ministry of Education is larger than the scope of criminal punishment.

  According to the current Korean law, the statute of limitations for public prosecutions for crimes of violence and insult is 5 years.

In other words, five years from the day when the act of violence or abuse occurs, the perpetrator cannot be punished legally.

Even if the victim filed a civil lawsuit against the perpetrator and demanded compensation, if the two parties met for more than 3 years from the day they met, the statute of limitations has expired and no further litigation can be filed.

Based on this, the judiciary also concluded that "it is difficult to pass the law to rescue the victims of campus bullying once they graduate."

South Korea’s social problems as the leading cause of school violence?

Surface response cannot cure chronic diseases

  Many perpetrators of school violence are actually victims of domestic violence, putting the violence they endured on others.

And parents who spoil their children too much will also condone their children to become perpetrators of school violence.

  The South Korean government has been working to solve the problem of school violence, but at present, the effect is insufficient.
