March 24, 2021The Lego brick model is saved.

This was established by the EU Court of Justice, thus overturning the decision of the EU Intellectual Property Office (Euipo) which had declared the design null and void.



The Court recalled that "Lego is the owner of the Community model" for "building blocks of a toy construction".



In 2019, EUipo sided with a competing German toy company, Delta Sport Handelskontor, who tried to declare the Lego design invalid. At the time, Euipo had considered that all the brick's characteristics "were imposed exclusively by the technical function of the product", that is, to allow assembly and disassembly, and not by design. The Danish Lego company then appealed to the EU court against this decision.



In today's ruling, the EU Court has denied EUIPO that it had not "taken into consideration all the characteristics of the appearance of the brick".
