On the 22nd, the Legislative Judicial Committee of the National Assembly (Judiciary Committee) held a legal review subcommittee and decided on legislation on the punishment of stalking crimes.



Stalking is an act that causes serious damage and trauma to the other person and can lead to serious crimes such as murder and sexual assault, but there have been no separate punishment rules until now.

Under the Misdemeanor Penalty Act, punishment is possible only through'continuous harassment', and the level of punishment is only fined, detained or fined down to 100,000 won, and criticized that it is not famous.



On this day, the Judiciary Committee acted as an act of approaching or watching the other party or his/her family without a justifiable reason against the other party's will, and the act of causing anxiety and fear in the other party by sending objects, texts, videos, etc. using the postal or information communication network As prescribed.




Subsequently, the case of continuous or repetitive stalking was defined as a'stalking crime', and imprisonment for up to three years or a fine of up to 30 million won. When dangerous objects such as weapons are used for stalking, the sentence is increased with imprisonment for up to 5 years or fines up to 50 million won.



In addition, according to the voted legislation, when a report of a stalking act is made and there is a concern that this will be done continuously or repeatedly, the police will be able to obtain post-post approval from the court after taking urgent measures such as prohibiting access within 100m.



In the process of investigating or judging a stalking crime, the court may take measures such as written warning, barring access to the victim, or detention, if deemed necessary to protect the victim.



The bills that were resolved by the Legislation Review Subcommittee on that day are scheduled to be finalized at the National Assembly plenary meeting after a general meeting of the National Assembly Judiciary Committee.
