March 15, 2021 First speech in Parliament by the new Minister of Justice, Marta Cartabia, who spoke before the Justice Commission of the Chamber.
In his hearing, which lasted about an hour, he pointed out that on justice it is necessary to "address the legacy of the previous government, verify what can be saved and implemented. The work done should not be thwarted but enriched without neglecting the proposals of the opposition".
Among the priorities indicated by the owner of Via Arenula there are: the reorganization of the administrative machinery, the enhancement of the staff, digitization, judicial building and prison architecture, specifying that "
next week we will present amendments to the texts already hinged
"for the reforms.
Cartabia explained how they will be addressed:" The most urgent and urgent problems "and" to the extent that there is sharing and support from Parliament "it will help" to answer at least some questions of justice that are burning in various areas of our country ". Indicating as urgent problems: reform of
civil justice
, reform of
criminal justice
, reform of the
judicial system
and of
the Superior Council of the Judiciary
.
The Keeper, illustrating its programmatic lines to the Justice Commission of the Chamber, placed attention of the auditors, in particular, the issue of
tax justice
. "There will be a chapter of tax reforms to face.
According to recent estimates, at the end of 2020 more than 50 thousand appeals were pending and from a qualitative point of view it can be observed that the Supreme Court often proceeds with the cancellation.
In terms of time, there are issues of waiting in the Supreme Court that exceed two years.
We must therefore intervene because there is still a lot to do.
A working group will be set up with the Mef for changes to tax justice ".
In addition, Cartabia highlighted the gaps in the
areas of the family
and
minors,
saying that" the area of family and juvenile justice deserves particular attention, in which the current legislation records a series of persisting gaps and problematic profiles of no small moment, among the most evident of which are those linked to the fragmentation of safeguards and the absence of an organic discipline for the
juvenile trial
".
With reference to the
renewal of the Council Superior of the Judiciary
has indicated the ways to follow against the dividing logic: "Discourage dividing logics that are not very suitable" to the nature of a constitutional body of the CSM, also through the "partial renewal" of the governing body of the judiciary. " Half of the laity and togates could be renewed every 2 years ", said the minister, explaining that an intervention
nto of this kind would serve not only to combat current logics, but also to give "greater continuity" to the CSM itself.
As regards the issue
of prescription,
Marta Cartabia highlighted how the problem is resolved with rapid processes: "A process with a reasonable duration would resolve the issue of the prescription relegating it to an exceptional event, far from media tools for the effective protection of the presumption of innocence. ".
