Karlsruhe (dpa) - In a first decision on the software update in the diesel scandal, the Federal Court of Justice (BGH) denied claims for damages against Volkswagen.

In contrast to the millions of secret use of illegal exhaust technology itself, VW is no longer to be accused of immoral behavior, the highest civil judge in Karlsruhe announced on Thursday.

The update, with which the manipulation software had to be removed from the affected cars after the scandal was discovered, cannot be compared with the technology initially used.

The plaintiff had claimed that the so-called thermal window in the update was also an inadmissible shutdown device.

He therefore wanted to return his VW Tiguan, which he had only bought after the scandal became known in September 2015.

He was unsuccessful in court in Rhineland-Palatinate.

The BGH now also rejected his complaint against the fact that no appeal was allowed.
