Protecting their rights and interests through legislative means can enhance their cohesion and centripetal force." Representative of the National People's Congress and member of the Standing Committee of the Chinese Federation of Returned Overseas Chinese Yu Jihua, vice chairman of the Jiangxi Overseas Chinese Federation, said in an interview with a reporter from China News Agency recently.

  "With the development and change of overseas Chinese, the number of overseas Chinese has continued to grow, and the structure has undergone profound changes." Yu Jihua said that overseas Chinese have become closer and closer to the domestic exchanges, and their expectations for sharing China's development dividends are increasing, and their demands for their own rights and interests are increasing. Diversity, all of which put forward higher requirements for further protection of the rights and interests of overseas Chinese.

  Yu Jihua noted that in recent years, although the work of protecting the rights and interests of overseas Chinese has achieved remarkable results, it also faces difficulties and problems. One of them is the lack of specialized legal support for the protection of the rights and interests of overseas Chinese.

  At present, Guangdong, Fujian, Shanghai, Hubei, Nanjing, Zhejiang, Dalian, Hainan, Sichuan and other places have successively formulated and promulgated regulations on the protection of the rights and interests of overseas Chinese, which has accumulated further experience for the local legislation and practice of the protection of the rights and interests of overseas Chinese.

Yu Jihua believes that from a national perspective, some key and difficult issues still need to be further studied.

  "The definition of the status of overseas Chinese is the most basic and fundamental issue in the protection of the rights and interests of overseas Chinese." Yu Jihua said that overseas Chinese are Chinese citizens designated to live abroad.

However, the meaning of "settlement" is not clear in law. How to explain "settlement" in a more scientific and reasonable way requires further research.

  In addition to the definition of identity, Yu Jihua believes that the identification of overseas Chinese-funded enterprises by relevant departments is also relatively vague, and related classification registration and statistical management work are also affected.

"In order to further protect and promote overseas Chinese investment in the country, research work on the definition of relevant concepts should be done."

  Yu Jihua said that in order to better encourage overseas Chinese to invest, innovate and start businesses in China, it is necessary to study and formulate relevant special provisions in the Overseas Chinese Rights Protection Law, such as improving government services in registration, finance, intellectual property, human resources, etc. Level, resolve the worries about children's education and spouse employment after overseas Chinese return home, improve the rights protection mechanism and unblock dispute resolution channels, etc., it is recommended to do related research work.
