Ajman Criminal Court has ordered that a servant recruitment office pay 21,000 dirhams to a citizen of the Emirate of Fujairah, the price of the recruitment fees for a maid who escaped, during the trial period, and ruled to terminate the contract between the two parties.

In detail, a citizen from the Emirate of Fujairah filed a lawsuit against a servant recruitment office, in which he demanded a fine of 21,000 dirhams for smuggling his maid, and to refrain from taking her back, under the pretext that she did not want to work for him, indicating that he was surprised by the presence of his fugitive maid in the same office that brought him from her since Only two months, confirming that the office promised him a full refund, and he did not do so.

The attorney general of the citizen, Amira Al-Suridi, indicated that the defendant was obligated to stipulate Article 4 of Federal Law No. 10 of 2017 in the matter of assistive service workers, which included “conducting the necessary medical examinations for the worker within 30 days at most prior to entering the country.

In the lawsuit papers, it was stated that Article 9 of the same law stipulated that “the worker shall be placed on probation for a period of six months, the date he received the work.”

Al-Suridi noted that Article 4/10 of Cabinet Resolution 22/2019 obliges the recruitment office to return to the employer the full amount paid by the latter in the event that the worker returns to the recruitment office or informs him if it is proven that he has a role in his escape or abstention, and in case it is not proven For him, this role shall be refunded from the amount equivalent to the remaining period in the worker's contract.

She indicated that her client contracted with the defendant to bring a maid for 21 thousand dirhams, but she refused to work after more than two months from the start of the service contract according to the fixed document of the defendant’s receipt of her, and the defendant was legally obligated according to the fixed texts to recover 21 thousand dirhams To her client in exchange for the maid's abstinence during her guarantee period.

The court ruled to terminate the contract between the two parties and oblige the defendant's recruitment office to refund the plaintiff's recruitment fees of 21,000 dirhams, and obligate the defendant to court fees, and 500 dirhams for attorney fees.
