The decision fell in the evening, this Tuesday.

The decree of the mayor of Nice temporarily banning seasonal rentals in his town is illegal, according to the Council of State which confirms its suspension.

Christian Estrosi (LR) had seized the highest French court after a previous decision of the Administrative Court of Nice.

The summary judge of the Council of State judges that, "in the absence of compelling reason linked to specific local circumstances, the ban by the mayor of Nice on seasonal rentals from February 6 to 20, 2021 is seriously and clearly illegal to property rights and to freedom of trade and industry ”.

He also points out that "the town does not justify the difference in treatment it creates between rentals and hotels, the opening of which remains authorized".

"Justice is done"

Faced with an increase in the incidence rates of Covid-19 in Nice, Christian Estrosi had asked the prefect of the Alpes-Maritimes to pronounce himself the temporary ban on seasonal rentals to avoid an influx of tourists during the winter holidays.

In the absence of a prefectural decision, the elected official himself had signed a municipal decree immediately denounced by professionals in the sector.

“The request of the municipality of Nice [before the Council of State] is rejected!

Justice is served ”, welcomed in the evening the Union of tourism rental professionals (UPLT).
