Prosecutor Helene Gestrin feels confident of getting a conviction - something she must be convinced of in order to even prosecute.  

- In addition, the public prosecutor has given me permission to prosecute.

It is necessary when what in this case is about Swedish citizens on international waters, she says.

What has actually happened, the prosecutor and the suspects unusually enough completely agree on.  

The journalist Henrik Evertsson and the wreck expert and Gothenburger Linus Andersson have been on a German ship at Estonia's crash site, sent down a diving robot and carefully documented the wreck.

They then found a larger hole in the side of the ship - something that is not mentioned in the Accident Investigation Board's report.

The result was reported in a documentary series.

The information has received a great deal of attention and has led to demands for both new investigations and for the law to be rewritten. 

However: Underwater, Estonian and Finnish law prohibits underwater work on site.

So the question is how this should be assessed in criminal law.  

The suspects point out that the site is located on international waters and that they worked on a German ship and are therefore covered by German law.

Inadequate investigation

Their purpose was to gather facts.

They believe that the original accident investigation is deficient and raises both questions and conspiracy theories.

And they assure time and time again that they were careful not to disturb the peace of the grave;

to just film from the outside, not pick anything up and leave the wreck exactly as they found it.

One of the world's largest media companies had first conducted a legal investigation and given the go-ahead.  

But are those objections enough?  

The Gothenburg District Court will now base this on.

The verdict will be announced on February 8.

Whatever the verdict, it is likely that the case will continue to both the Court of Appeal and the Supreme Court.
