  The Cyberspace Administration of China issued the newly revised "Regulations on the Management of Internet User Public Account Information Services" on January 22, which will be implemented on February 22, focusing on cracking down on false information, false traffic and other violations of laws and regulations.

  Compared with the original regulations that came into effect on October 8, 2017, the number of new regulations released this time has been increased to 23, especially for the inadequate implementation of the main responsibilities of some public account information service platforms and production operators, the inadequacy of self-discipline and heteronomy, and The lack of content review and control mechanism and other issues have increased the corresponding regulatory content.

  In terms of combating false traffic, the new regulations point out that the public account information service platform should establish a public account monitoring and evaluation mechanism to prevent data fraud such as the number of account subscriptions, user attention, content click-through rates, and forwarded comments.

The platform may suspend or terminate the provision of services according to the service agreement for public accounts that users do not log in or use for more than six months after registration.

  Public account producers and operators must not manipulate multiple platform accounts, publish homogeneous information content in batches, generate false traffic data, and create false public opinion hotspots; must not fabricate false information, forge original attributes, label false information sources, distort facts, and mislead The general public; it is not allowed to use methods such as paid release and deletion of information to implement illegal network supervision, marketing fraud, extortion, and seek illegal benefits.

  According to the relevant person in charge of the National Cyberspace Administration of China, current online information content is vulgar and vulgar, malicious hype, emotional venting, malicious attacks, plagiarism and other problems are prominent, which seriously affect the network ecology and destroy the network civilization.

  Especially during the prevention and control of the new crown pneumonia epidemic, a small number of “self-media” maliciously fabricated and spread online rumors and arbitrarily spread the privacy of others, which seriously affected social harmony and stability and harmed the legitimate rights and interests of others.

  The person in charge stated that the current public account information service is driven by new technologies and applications of network communication such as information flow, algorithm recommendation, group circle sharing, platform distribution, etc., accelerating the presentation of new features such as professional production, organizational communication, and commercial operation. But at the same time, chronic diseases such as cyber warriors, malicious marketing, extortion, piracy and infringement have been cured repeatedly, seriously affecting the ecology of public opinion and disrupting the order of transmission.

  To this end, the new regulations further clarify the support and protection responsibilities, and guide and encourage public account information service platforms and production operators to vigorously produce high-quality information content that is upright, truth-seeking and beautiful.

  How can the public account information service platform better implement the main responsibility?

In accordance with the "Network Security Law of the People's Republic of China", "Regulations on the Ecological Governance of Network Information Content" and other relevant national regulations, the new regulations have added ecological governance, data protection, personal information protection, intellectual property protection, credit evaluation, and classified management The main responsibility of the platform.

  On this basis, the new regulations have added a number of new clauses for prominent issues such as account classification registration, real identity registration, subject qualification verification, account trading, combating online rumors, account operation specifications, and data traffic fraud.

In addition, the official account information service platform should also strengthen the supervision and management of the platform's official account information service activities, and promptly discover and dispose of information or behavior that violates laws and regulations.

  As for the production and operation of public accounts, both content producers and account operators have certain public opinion generation capabilities and social influence, and shall be responsible for the safe production of their content and the legal and compliance operation of their accounts.

  The new regulations point out that in terms of content security, production operators shall establish and improve the entire process review mechanism for editing, planning, production and release, and strengthen the "three checks" of content orientation, authenticity, and legality, in order to maintain a good communication order.

  In terms of account operation, production operators have established and improved the entire process of safety management mechanisms for public account registration and use, operation promotion, etc., and operated public accounts in a civilized and standardized manner in order to maintain a good social image.
