Schleswig (dpa / lno) - The Schleswig Administrative Court has rejected a lawsuit by the municipality of Sylt against a spatial planning contract (ROV) on Sylt concluded between the other island municipalities and the state.

There is no need for the coveted emergency legal protection, the court ruled on Friday (Ref .: 8 B 28/20).

The municipalities of Hörnum, Kampen, List and Wennigstedt-Braderup closed the ROV with the state of Schleswig-Holstein in mid-December.

The contract is intended to enable the construction of affordable apartments for permanent use in their area.

The municipality of Sylt, which includes Westerland, had rejected the contract.

An appeal against the decision can be lodged with the Schleswig-Holstein Higher Administrative Court.

The aim of the emergency application was to temporarily prevent the implementation of the contract.

The municipality of Sylt argued that it was suffering damage in terms of the perception of its central local function.

The contract also deviates from the previous housing development concept.

The other municipalities should therefore be prohibited from adopting development plans on the basis of the contract.

The administrative court, however, came to the conclusion that there was no need for legal protection for the urgent application.

The municipality of Sylt has sufficient legal protection available through a subsequent judicial review of the development plans.

According to the Kiel Ministry of the Interior, the spatial planning contract considers the entire need for new construction on the island.

The communities themselves decide on the specific development of their areas. If possible, apartments should be built on areas that have already been sealed.

But there are also critics on Sylt who fear that the living space problem will not be solved, but only more areas will be sealed.
