On Friday, the Berlin Court of Appeal rejected an urgent motion by the Brandenburg state parliament member and former AfD state chairman Andreas Kalbitz against his expulsion from the AfD.

This means that the 48-year-old can still not exercise his rights as a party member.

The Berlin district court is now to decide in a main hearing on Kalbitz's lawsuit against the federal executive board.

No date has yet been set for the procedure.

In the first instance, too, the regional court had rejected Kalbitz's urgent application for interim legal protection last August. The 43rd Civil Chamber stated that it had not been able to determine that the decision of the AfD federal board of May 2020 to terminate Kalbitz's membership in the AfD was evidently illegal.
