The Al Ain Court of First Instance obligated a young man to pay a woman 30,000 dirhams in compensation for the material and moral damages suffered by her daughter, as a result of a traffic accident that he caused, and resulted in injuries and scrapes to her.

The mother of the child had filed a lawsuit against the young man, requesting that he be obligated to pay her - in her capacity as the guardian of her daughter - an amount of 100,000 dirhams, in compensation for the material and moral damages suffered by the child, noting that her daughter had suffered a traffic accident in a car the defendant was driving. The accident exposed her to separate injuries, and she said that the defendant was indebted to the incident according to a final criminal judgment.

The medical report, which was submitted by the mother within the lawsuit papers, showed that her daughter suffered severe scratches in both the forehead and the right elbow, which resulted in moderate open wounds. The court decided to assign the forensic doctor to sign a medical examination on the plaintiff’s daughter, to explain the injuries she suffered as a result of the accident she was exposed to, whether or not she recovered from her, whether or not she had a permanent disability, and the percentage of disability, in accordance with the provisions of Islamic Sharia.

The court indicated that the documents evidenced the defendant’s conviction in the criminal case for a charge that caused injury to the plaintiff’s daughter as a result of his negligence and lack of caution by driving his vehicle negligently and without attention, which led to the accident and the injury of the child, and the ruling became final not to appeal against him.

The court confirmed that what is proven from the medical report attached in the papers is that the traffic accident that the plaintiff’s daughter was subjected to resulted in severe scratches in the forehead and right elbow, as well as moderately open wounds, leaving her with no deep wounds or threatening problems, pointing to The injuries require material and moral compensation for the physical damage and psychological pain that befell the plaintiff’s daughter, and for what she felt in terms of fear, dread and pain at the moment of the accident, which constitutes moral damage to her.

The court ordered the defendant to pay the plaintiff, in her capacity as custodian of her daughter, an amount of 30,000 dirhams.
