One is to grant supervision power, and the other is to restrict supervision power.

The power of supervision is to clarify what the supervision is, what institutions can carry out supervision, who is the subject of supervision, and what is the content of the supervision. This is the basic problem to be solved in the formulation of the "Regulations on Government Inspection Work" .

  On the same day, the State Council Information Office held a regular briefing on the State Council’s policies. Fan Bi briefed the media on the “Regulations”.

  It is understood that government supervision is an important means to promote the implementation of the decisions and arrangements of the Central Committee of the Communist Party of China and the State Council. It is an important part of improving the administrative supervision system. It is important for ensuring the smooth flow of government orders, improving administrative efficiency, promoting the full performance of government duties in accordance with the law, and advancing the national governance system. The modernization of governance capabilities is of great significance.

The "Regulations" require that government supervision work must adhere to and strengthen the party's leadership, center on the people, serve the overall situation, seek truth from facts, promote administration according to law, and promote policy implementation and problem solving.

The "Regulations" will come into effect on February 1, 2021.

  Fan Bi introduced that the concept of government supervision refers to the supervision and inspection carried out by the people's government at or above the county level in accordance with the needs of the work within the scope of statutory powers.

Regarding the subject of government supervision, the people's government at or above the county level is the subject of government supervision, and the specific work is undertaken by the government supervision agency.

People's governments at or above the county level may designate their departments or dispatch inspection teams to carry out government inspections.

Other administrative agencies shall not conduct government supervision.

  As for who the inspection object is, Fan Bi introduced several levels: the department of the people's government at the same level where the inspection agency is located, the people's government at the lower level and its departments, and the organization with the function of managing public affairs, including relevant laws and regulations. Organizations authorized to manage public affairs and organizations entrusted by administrative agencies to manage public affairs can also be subject to inspection.

  Regarding the results of the inspection, Fan Bi pointed out that the "Regulations" require that an inspection conclusion be made after the inspection.

The inspection conclusion must be clear in facts, sufficient evidence, objective and fair, and conclusions related to the inspection object must be fed back to the inspection object.

  In addition, Fan Bi introduced that the "Regulations" put forward requirements for avoiding formalism and bureaucracy, and avoiding the generalization of inspections, requiring strict control of the frequency and time limit of inspections, scientific use of inspection methods, and strict implementation of inspection plans.
