“By issuing a decree of December 29, 2020, the President of Ukraine went beyond his constitutional powers and applied measures to ensure criminal proceedings against a judge of the Constitutional Court of Ukraine, which, in accordance with the constitution and laws of Ukraine, cannot be applied to judges of the Constitutional Court of Ukraine.

From a constitutional and legal point of view, the decree of the President of Ukraine is legally null and void and cannot be enforced, since it was issued by the President of Ukraine in excess of his constitutional powers, ”reads the message of the Constitutional Court of Ukraine.

The Constitutional Court also pointed out that the fact that a judge of the constitutional court was appointed by the president does not give him the authority to remove him from justice.

On December 29, it was reported that Zelensky signed a decree on the removal of Alexander Tupitsky from the position of a judge of the Constitutional Court.
