Hanover (dpa / lni) - The Lower Saxony state cabinet has decided to revise the rent brake.

The cap no longer applies in Leer and Vechta because of many new buildings, as the building ministry announced on Tuesday.

Accordingly, rents are capped in Hanover, Braunschweig, Oldenburg, Osnabrück, Göttingen, Lüneburg, Langenhagen, Laatzen, Buchholz in the Nordheide, Buxtehude, Wolfsburg and on the East Frisian Islands.

The regulation comes into force at the beginning of January.

"We are now creating clear conditions," said Lower Saxony's building minister Olaf Lies (SPD).

The rent brake introduced in 2016 was lifted by the Hanover Regional Court in August.

The reason for this was that there were no reasons for capping the rents, according to the court (Ref .: 7 S 7/20).

At the beginning of the year, the state government commissioned an expert opinion that analyzed the situation on the housing markets and suggested in which municipalities the rent cap should apply.

On the basis of the report, a draft for a new tenant protection ordinance had been drawn up, the ministry said.

The municipalities were then able to comment.

The rental price brake states that the price for new rentals should only be ten percent above the local comparable rent.
