The Traffic Court indicted the accused criminally for having injured the worker by mistake, and the plaintiff filed a lawsuit before a full civil court demanding that the defendant who caused the accident and the insurance company pay him the compensation estimated by the court and Al Jaber for the material and moral damages incurred by him as a result of the accident, and obligating them to pay fees, expenses and attorney fees .

He explained that he suffered psychological, material and moral damage as a result of the accident, and he spent money on physical therapy, in addition to what he would spend in the future for treatment, pointing out that he had been absent from his work for five months without a salary (3200 dirhams per month), which incurred financial losses of 16 thousand dirhams, in addition to To the moral damages he suffered as a result of the accident.

The attorney of the cause of the accident indicated that he rejects the lawsuit filed by the plaintiff, and requested that he be removed from the lawsuit without expenses, and the insurance company’s agent submitted a defense memorandum in which he demanded that the case not be accepted for filing other than the way prescribed by the law. The plaintiff is in the left forearm, and the compensation is estimated at the lowest possible amount of 5000 dirhams, in exchange for the plaintiff’s fracture in his left forearm as a result of the accident.

The court ruled that the two defendants pay the plaintiff 100 thousand dirhams redemptive compensation for the material and moral damages incurred by him as a result of the accident and obligated them to pay fees and attorney fees.
