The Dubai Public Prosecution revealed that the total number of criminal cases appealed since the beginning of this year and until the end of September amounted to 4,159 cases, including 1018 appeals by members of the Public Prosecution, while one of the parties to the cases decided 3,141 appeals.

The Chief Prosecutor, First Counselor, Muhammad Sharif Al Ali, told Al-Emarat Al-Youm that the appeals decided by the prosecution members included 573 appeals during the first half of this year, then the rate increased dramatically, and by 113 appeals during one month, bringing the number recorded. On the other hand, he added, the total number of criminal appeals that were appealed against at the Court of Cassation during the same period reached 893 cases, including 73 discrimination decided by members of the Public Prosecution, while the number of appeals against discrimination decided by one of the lawsuit parties reached 820.

Regarding the difference between the appeal by appeal and the appeal by cassation, Al Ali explained that there are a number of basic differences, the first of which is in the period of appeal, as the convicted defendant may appeal the appeal against the first instance within 15 days from the date of pronouncement of the judgment in the presence of the court, while the defendant who has been sentenced may appeal with cassation on The appellate judgment is within 30 days from the date of pronouncement of the judgment in presence.

He pointed out that the second difference relates to the appeal procedures, so the accused person or his representative may appeal the judgment issued against the accused, and to accept the appeal by the appeal, the convicted person must deposit a deposit of 500 dirhams in misdemeanors, and 200 dirhams in violations, while he must sign the reasons for the appeal. The lawyer of the convicted person shall be entitled to cassation, provided that he is accepted before the court of cassation, and if the cassation appeal is filed by the convicted person with a fine or if the judgment is issued suspending the execution, then for his acceptance, the one who raises it must deposit 1000 dirhams in the court's treasury as a form of insurance.

As for the third difference, it relates to the reasons for the appeal, as the reasons for the appeal must be substantive or legal from the one who filed it, such as the patent application, the reduction of the penalty, or the cancellation of deportation, while the reasons for appealing by cassation are only legal, and are determined exclusively, in violation of the law or error. In its application, or if there is a nullity in the judgment or in the procedures, or if the court has ruled in the claim of a civil right beyond the litigant’s request, or if the appealed judgment is empty of reasons, or it is insufficient or ambiguous, or if two contradictory judgments are issued in one incident .

Al Ali stated that the fourth difference is related to the presence of the convicted person, in the event that the primary imprisonment sentence is not executed, the convicted person must attend the first session to consider the appeal and present himself for implementation, otherwise his appeal shall be dropped, while the Court of Cassation decides the appeal submitted to it without the need for the accused to be present. .

He pointed out that, in all cases, if the appeal by appeal or by cassation takes place only upon the request of the convicted person without the request of the Public Prosecution, then the court may not increase the punishment for the convicted person, in accordance with the principle established upon him: “The appellant shall not be harmed by his appeal.”
