False Guilty The 'toll' of the murderer of the Olympic Village of Barcelona
The
Valencia Court
has sentenced two of the three civil guards accused of lying to one year and six months in prison in a trial against Valentín Moreno, known as the murderer of the Olympic Village, for the kicking death of the young
Carlos Javier Robledo
at the doors of a nightclub in the port of Barcelona on April 1, 2000.
The two agents, according to the thesis of prosecutor
Víctor Montes
, "failed to be truthful in a substantial aspect" of the statement that both gave together with a third colleague -who has been acquitted- when formalizing a statement in which they accused Valentín Moreno - sentenced to nine years of imprisonment for murder and then for a racist attack in a party - and another criminal who is a habitual offender on the streets of Barcelona for attacking one of them with his vehicle.
The events date back to the early morning of June 13, 2016, when a patrol boarded the car in which they were traveling and stopped to collect the toll ticket.
Both civil guards were part that night of a device that tried to locate a stolen car and a second "mother" vehicle that had been detected from the

The agents assured that they had signaled the control and that the
Renault Scenic
that Valentín Moreno and his partner were occupying entered the toll booth very quickly, as if it were fleeing.
The report also indicated that the officers were wearing reflective vests and flashlights and that, when they stopped him, the car made a strange movement and, reversing, rammed one of the officers.
The blow, according to the report, would have caused injuries, the most serious in the knee, and would have forced him to go to the hospital and request temporary discharge from the service.
With the falsified report and his statement in the trial, the guards tried to charge a crime of attack on an agent of the authority in the modality of "attack", that is, using a motor vehicle.
In fact, they sat the two criminals on the bench, also accused of resistance and illegal possession of weapons.
However, in the oral hearing all the cake and the lies of the agents were exposed when one of the parties requested the viewing of the recordings of the security cameras of the highway tollbooth.
The images, incontestable, knocked down the version of the civil guards and ended up sitting on the bench.
The sentence in that case acquitted the two criminals of all charges, including injuries and illegal possession of weapons, despite the fact that Valentín Moreno admitted that the extendable baton they found in the glove compartment was his.
The judge understood, however, that the baton was not exhibited or used to threaten the agents who jumped on the car.
In addition to the acquittal of
Valentín Moreno
and his companion in the vehicle, the prosecution requested to deduce testimony against the civil guards for lying in the trial to falsely accuse Moreno.
Now, the sentence that condemns the members of the Benemérita considers it proven that the injuries to the Civil Guard were caused by himself in an accidental fall "when he approached the vehicle in question."
At the oral hearing, the defense of the civil guards asked for his acquittal, claiming that they were never aware of being untrue and that what happened "was an erroneous perception of what happened."
However, the court of the
Third Section of the Hearing
, whose president is Judge Carmen Melero, does not believe this version because it is "crystal clear" with the viewing of the recording that the agent "knew how the injuries had occurred ".
The acquitted officer ended up admitting that he had not seen what had happened with his partner.
And what had happened is that his partner was approaching the vehicle "on the run", when he slipped when he reached the level of the car at the moment when he was already "stopped" and at no time did he reverse.
They also did not show the images that, as the report claimed, the detainees showed resistance and refused to identify themselves.
The penalty imposed on them is the minimum - and they will not have to go to prison - considering that the guards "are agents of the authority" and the testimony given, although a lie, was produced in an "act of service."
The ruling considers that
the agents lied at the trial
despite the fact that they had been warned of "incurring criminal responsibility" if they did not tell the truth about what happened that night at the tollbooth.
The sentence is certainly benevolent towards both guards as they could have been accused, in addition, of documentary falsification and removed from the body for a very serious crime.
