“Misdemeanor Ras Al Khaimah” owes a Gulf woman to embezzlement of her husband's money

The Misdemeanor Court in Ras Al Khaimah fined a (Gulf) wife 2,000 dirhams for embezzlement of her (Gulf) husband, while the wife filed a divorce lawsuit against the husband for assaulting her and expelling her from the house and not taking responsibility.

In detail, the case management office in the courts of Ras Al Khaimah is looking into a divorce lawsuit filed by a Gulf wife, in which she demanded her divorce from her husband due to the grave harm that occurred to her as a result of beating her, insulting her and her family, and abandoning her in bed for long periods in order to harm her and institute a case before the competent courts accusing her of embezzling money from him, what He hit her, and it became impossible to stay together.

She explained that her husband had beaten her since the beginning of her pregnancy, and he expelled her from his brother's house in which they were staying, and disavowed his responsibility as a husband and father, insulted her and her family, and did not provide her with an independent residence.

She indicated that she filed a lawsuit last year to prove alimony before the Personal Status Court, and the court ordered her to oblige the husband to provide a separate house and pay one thousand dirhams per month for her, and two thousand dirhams as alimony for their child, provide their life expenses and house requirements at a value of two thousand dirhams, and buy gold for her worth 40 thousand dirhams.

She added that after obtaining the verdict, her husband accused her of embezzling cash from him, although he asked her to keep that money in her private bank account, and then he filed a lawsuit against her on charges of embezzlement to harm her.

She pointed out that she tried to be patient with the damage inflicted on her, and was no longer able to bear it, fearing for her life and the life of her daughter, asking for her to be divorced by khula, and for proof of custody of her child and obligating him to fees, expenses and attorney fees.

For her part, the husband's defense attorney, Hanan al-Bayadh, indicated that disputes occur daily between spouses, and a house is not without disputes and quarrels, given the pressures of life, and does not require division, divorce, destruction of a legal home, and a marriage that yields a child.

She added that her client refused, before family directives, to take off his wife, because he loved her, and wanted him to stick to her and their daughter, and that he could not dispense with them, and that he was not satisfied with the khula '.

She explained that the wife gave up the deferred dowry, the waiting period, and the fun in exchange for taking her off from her husband, because the correct view is that she does not deserve the pleasure, nor the alimony, because it is not permissible for her to give up something that she does not possess.

She pointed out that the wife's misdemeanor court conviction on the charge of embezzling her husband indicates that she is not worthy of the custody of her child, and the husband has what is suitable for raising the foster child, which is his mother and two sisters, as one of the conditions for dropping custody in accordance with the law is that the custodian has the mind, puberty, trustworthiness, and the ability to raise, maintain, care and safety for the child It is a serious contagious disease, and it is not preceded by a judgment of crimes committed against it, as the wife's conviction of a case of embezzlement necessitates dropping her custody of her minor child.

And she asked the court to reject the divorce lawsuit, and as a precautionary measure in the event of a judgment for the wife to divorce khula, that the wife pay him the appropriate allowance for the material damage he suffered as a result of his incurring marriage expenses, which is what he was unable to marry in the future again, and the ruling to drop the custody of the child, and hand it over to her father due to lack of The availability of the trust clause to accuse her previously in the case of embezzlement.
