Buildings (dpa / sn) - The Saxon Higher Administrative Court (OVG) has confirmed the quarantine obligation for returnees from abroad.

It rejected an urgent application from a man from Leipzig who wanted to return home from his second home in Mallorca in the next few days.

The man had requested that the Saxon corona rules should be temporarily suspended on this point.

The plaintiff had relied on a decision from North Rhine-Westphalia.

There the OVG decided in November that the regulation for travelers returning was disproportionate.

The quarantine requirement is of no use in combating pandemics if travelers return from areas where the number of infections is lower than in Germany.

The OVG in Bautzen first stated that the question had not yet been finally clarified.

It weighed the interests of the man against those of the general public.

With the quarantine regulation, the Free State is pursuing the legitimate goal of infection protection, the court said on Thursday.

The obligation to segregate is indeed an encroachment on fundamental rights, but it is being toned down because the quarantine is allowed to take place at home and one can also "free oneself".

In the view of the court, the interests of the Mallorca returnees weigh less heavily with this consideration.
