Magdeburg (dpa / sa) - When it comes to the question of whether the corona restrictions are permissible in Saxony-Anhalt, the state constitutional court wants to give first answers.

The judges in Dessau-Roßlau will make a decision on Tuesday after a corresponding urgent motion from the AfD parliamentary group, as a court spokeswoman announced on Monday evening at the request of the German press agency.

Specifically, the questions are whether the Corona regulation may stipulate how many people may meet, whether the ban on tourist overnight stays and the closure of restaurants are permissible and whether there may be a catalog of fines for violations.

The AfD in the Magdeburg state parliament called the state constitutional court at the end of November.

The MPs around parliamentary group leader Oliver Kirchner consider the current restrictions to be excessive, inappropriate and unsuitable.

In addition to the urgent procedure, the constitutional judges must also fundamentally check whether the state government can resolve such serious interventions in fundamental rights or whether the state parliament must be involved.

This question is to be clarified later in the main proceedings with an oral hearing.

In Saxony-Anhalt, government ordinances have been in effect since the beginning of the pandemic in March, which stipulate restrictions on public life.

They were relaxed significantly in summer and tightened again with a significant increase in cases in autumn.

The rules are intended to slow down the further spread of the coronavirus so that hospitals can treat all seriously ill and health authorities can track all chains of infection.

The higher administrative court in Magdeburg had recently rejected almost all lawsuits against individual corona rules.
