The accused said, in the investigations of the Public Prosecution, that he had a friendly relationship with that woman, and took her on the day of the incident to the farmhouse in the Al Tayy area, pointing out that at about 11:30 pm, he asked one of the workers to prepare charcoal to smoke the hookah, and put it in the vessel designated for that. For his part, the defendant’s defense attorney, the International Center for Advocacy, stated that the causal link between error and death has been disconnected due to the presence of an external factor that is winds, indicating that the elements of the crime are absent from the right of the accused, and that what is established in the provisions of discrimination is the questioning of the accused for his criminal act, unless factors intervene External breaks the link of causation.

After considering the case, which coincided with the period of the national sterilization program, in light of precautionary measures against the emerging corona virus (Covid-19), the court obliged the accused to pay the legal blood money to the heirs of the victim at a rate of 200 thousand dirhams, in addition to his imprisonment for a year with a suspension of execution for a period of three Years, starting from the day the judgment becomes final.
