France: "Separatisms", what does the bill provide?

The text was eagerly awaited.
The government has finalized its bill aimed at combating radical Islamism.
Defended by the Ministers of the Interior and of Justice in Le Figaro, it emphasizes associations and schools, but evolved with the assassination of Professor Samuel Paty on October 16.

The bill creates two new crimes, directly inspired by the assassination of
Professor Samuel Paty
, who was harassed online for weeks after showing his students caricatures of Muhammad.
First, a crime repressing hatred online, then specific sanctions for the pressure exerted on State agents (teachers, health professionals) and elected officials.
A center of magistrates specially dedicated to the fight against online hatred will be created.
"

the Keeper of the Seals, Eric Dupont-Moretti.
No creation, however, of an offense of separatism.
This had been envisaged, but no legal formula could be found.
By jointly presenting
the text
to
Figaro
, the Ministers of the Interior and of Justice wanted to display a concerted effort, combining legal certainty and firmness against radical Islamism.
Symbol of the desire not to be retouched the text, the Keeper of the Seals arrived at each meeting with a Penal Code under his elbow.
Increased control of associations

Several articles of the bill therefore strengthen the arsenal in this area: modernization of the grounds for dissolution, obligation for associations to commit to respecting the principles and values of the Republic.
In the event of a violation, the grants may be returned.
An anti-coup system is also planned to prevent any takeover of a mosque by extremists.
Better control also of religious associations and therefore of mosques, with a modification of the law of separation of churches and the State of 1905, in particular the obligation to declare any foreign funding.
Strictly supervised home schooling
The discovery, in particular, in Seine-Saint-Denis, of illegal schools convinced the government of the need to act.
We must "
save the children from the clutches of the Islamists,
" insists the Minister of the Interior in the
Figaro
.
Article 18 of the bill therefore defines a new framework: no child aged 3 to 16 will be able to derogate from the obligation to attend a public or private educational establishment, except when schooling is made impossible.
A family component
The Minister in charge of Citizenship, Marlène Schiappa won her case.
The issuance of a virginity certificate will be prohibited.
The bill will be presented to the Council of Ministers on December 9, before being debated in Parliament.
