In her country, or in the Emirates if she is present in the country, granting her full guardianship over him, and obligating the father to pay expenses

The father did not comply with the implementation of the ruling, and he completely disappeared, so the mother's attorney, Awatef Mohamed, petitioned the court for his arrest, and a decision was issued, and the police were able to locate him and recover the child.

The mother told «Emirates Today», that not a day went by without thinking about my son, my ex-husband managed to burn my heart on him for two years, during which I slept crying every night, until the Dubai police returned my son to my lap, pointing out that she came to The state since the opening of the airspace, and it remained a temporary resident until the ruling was implemented.

The Personal Status Court stated, in the merits of the custody ruling, that the street made the matter of child custody a matter for women, because the child at this stage needs to be taken care of, because they are more affectionate and more patient in bearing the hardships, affirming that the mother is the most deserving of the people to custody of her young son even without He asked her, because this is the law of innateness that God created people upon.

The Personal Status Court in Dubai settled the legal dispute for the mother, after the case had gone through three previous litigation stages: the first in a first instance court that ruled that it had no jurisdiction to consider it, then the appeals court that upheld the same ruling, until it reached the Court of Cassation that overturned the two previous judgments. And the case was sent back to the Personal Status Court.

According to the case papers, the couple officially separated in their country two years ago, and the child was in the custody of his mother, until the father (45 years) asked to take him on vacation in Dubai, and then cut off communications with his ex-wife, since December 2018.

The court in Dubai viewed a copy of a pledge signed by the father in his country, that he would return the child again, but as soon as he arrived in the Emirates he sent his ex-wife a text message telling her that he would burn her heart on the child and she would not see him again, and he issued a decision to prevent his travel in order to ensure that.
