50 thousand dirhams in compensation for a wife whose husband hit her with a charger cable and put out cigarettes on her body

The Abu Dhabi Court of First Instance ordered a man to pay his wife, customarily, 50 thousand dirhams in compensation, for beating her with an electric charger cable, and putting out cigarettes on her body, after she confessed to him - according to his statements in the investigation report - by introducing a person to the hotel room, after he left, and practicing adultery with him.

In the details, the plaintiff filed a lawsuit accusing the defendant of physical assault, with his hand and leg, and an electric charger cord, hitting her face on the table, and putting out cigarettes on her body.

She left severe physical and physical injuries, which were proven by a medical report.

She supported her claim with a copy of a first aid report issued by a hospital, and a copy of a medical report issued by a psychiatric hospital, indicating that she suffers from general anxiety, confusion, severe fear, insomnia and loss of appetite. The case papers indicated that the defendant was asked when asked by the Investigation and Criminal Investigation Department. Regarding the incident, he acknowledged the assault on the complainant, as they were customarily married, and there is a paper to that effect and two witnesses, and he explained the reason for his assault on her as she brought a person into the hotel room in which they were staying, and committed adultery with her.

He said that he saw injuries on her face and asked about her, and she admitted that she had brought someone who had committed adultery with her and had assaulted her.

In its ruling, the court indicated that Article 282 of the Civil Transactions Law stipulates that “all harm to others must be done by the perpetrator, even if he is not distinguished by the guarantee of damage,” noting that based on the foregoing, the elements of liability, including error, damage and causal relationship, have been provided on the plaintiff’s side. Therefore, from what this lawsuit has been filed on from reality and the law, it is also not possible to explain the statement of the injured person in the records prepared during the period of inference with the police, that he does not complain about the person who caused his injury, considering that saying that it was a waiver by the victim who was wrongfully injured. It is proven yet, and therefore it cannot be considered a waiver of his right to compensation for damage before the person who caused the damage or before the insurance company.

The court confirmed that it found to her that the defendant had assaulted the plaintiff, which is considered an error on his part that led to injuries to her that were hospitalized, and the defendant's mistake was fixed, and the assault incident resulted, as is proven in the medical report, the occurrence of multiple bruises on the face and scalp , And a large swelling of blood on the left side of the face, and traumatic injuries to the forearms, wrists, hands and back, and receiving psychological treatment, what incurred the plaintiff's sums and expenses.

The court indicated that it adheres to the requests received, for the physical compensation, which the court estimates at an amount of 30,000 dirhams, in addition to the moral and psychological damage that the plaintiff suffered, and the feeling of sadness, grief and sadness that befell her because of the defendant beating her, which the court considers assessing compensation To the plaintiff for all these damages at an amount of 20 thousand dirhams.

The court ruled to oblige the defendant to pay the plaintiff 50 thousand dirhams with the legal interest at 5% from the date of its becoming final.
