 Improve the basic system of biosafety risk prevention and control

  The Biosafety Law stipulates penalties for non-action or non-action of public officials in accordance with the law in the legal liability section. At the same time, it has perfected the corresponding responsibilities and penalties for acts and incidents such as the misuse of biotechnology that occurred in the previous period.

Actively respond to new challenges facing biosafety

  On June 2, the Ministry of Ecology and Environment issued the "Communiqué on the State of China's Ecological Environment in 2019".

The communiqué shows that more than 660 invasive alien species have been discovered nationwide.

Among them, 71 species have caused or have potential threats to the natural ecosystem and are included in the "List of Invasive Alien Species in China".

The survey results of invasive alien species in 67 national nature reserves indicate that 215 invasive alien species have invaded the national nature reserves.

  In order to prevent and respond to the invasion of alien species and protect biodiversity, the Biosafety Law stipulates that the relevant departments of the State Council strengthen the investigation, monitoring, early warning, control, evaluation, removal and ecological restoration of invasive alien species according to the division of responsibilities.

No unit or individual may introduce, release or discard alien species without approval.

Anyone who violates the provisions of this Law and introduces alien species without approval shall be confiscated by the relevant departments of the people’s government at or above the county level according to the division of responsibilities and imposed a fine of 50,000 yuan to 250,000 yuan.

  In recent years, controversy over ethical issues caused by biotechnology has continued.

In this regard, the Biosafety Law clarifies that engaging in biotechnology research, development, and application activities should comply with ethical principles.

The clinical research of new biomedical technologies shall pass ethical review and be carried out in medical institutions with corresponding conditions; the operation of human clinical research shall be carried out by health professionals who meet the corresponding conditions.

Relevant scientific research institutions, medical institutions, and other enterprises and institutions shall incorporate biosafety laws and regulations and biosafety knowledge into the content of education and training, and strengthen the cultivation of biosafety awareness and ethical awareness of students and practitioners.

  The field of biosafety is generally an emerging field, covering a wide range and rapid development and changes. Some fields have been adjusted by laws and regulations, and some activities lack legal standards.
