The Balearic Islands defy the Ombudsman and impose Catalan in the classrooms
Spanish disappears from Infant and Primary education in the Balearic Islands
They force schools to publish the subjects they teach in Spanish
They got the linguistic projects of the educational centers of the Balearic Islands.
They investigated in which language the students of each school studied.
Later they
denounced that 90% of the schools in the Balearic Islands practiced language immersion "illegally"
.
They took the complaint to the Ombudsman, the Department of Education and the High Inspection.
A year and a half after
battling against the imposition of Catalan in Balearic public education,
PLIS Education, please take the last step before bringing this discrimination to justice
.
"If we receive a negative response or silence, we will go to court," he advances.
This association of teachers, which defends the school as a place of learning and not as a means of instrumentalization, has put the Government of the socialist Francina Armengol in check and
has just asked 291 schools and institutes in the Balearic Islands
to comply with the law and den at least 25% of hours in Spanish.
Backed by the Balearic Civil Society
, both associations have addressed requests for modification of their language projects, warning that they
violate the legal system
.
They claim the presence of Spanish as the vehicular language
of instruction in at least 25% of the teaching hours in all educational stages, and recall that
at least one core or similar, non-linguistic subject must be taught in Spanish
(in addition to the subject of Spanish Language and Literature).
"It is
surprising that in Spain it is so easy to breach the law
and that we have to be ordinary citizens like us who, with sentences and recourse to justice, have to defend our rights", laments
Tomeu Berga, president of the Balearic Civil Society
, who recalls that the language projects of the centers must be compatible with the law and jurisprudence,
as endorsed by the Ombudsman
.
In his latest report, Francisco Fernández Marugán stated emphatically that language projects must consider Spanish as a vehicular language in a
reasonable proportion
and that the jurisprudence of the Supreme Court has established this proportion in
a minimum of 25% of the teaching hours
and in at least one core subject, apart from Spanish.
The president of PLIS, Josep Ignasi Aguiló, recalls that
the directors are responsible for the linguistic projects
, which are the documents where it is detailed in which language each subject is given.
Until now
accessing these documents was almost an impossible mission
.
Although the law requires them to post them on the website, many did not include them or referred to broken links or outdated information.
Without Spanish in 93%
According to the PLIS study,
in 93% of children's centers on the islands, Spanish does not exist
;
and in 80% of primary school students, it is reduced to the subject of Spanish Language, exactly the same as the foreign language.
PLIS began a
long legal battle against the Balearic Government
in 2019
so that parents had access to these documents and today it has only achieved 65%.
Faced with the silence of Minister Martí March,
the teachers went to an arbitration court
, handed them over, analyzed them and concluded that almost 90% of the analyzed schools practice immersion illegally.
PLIS
raised the complaint to the Ombudsman
and the latter is still awaiting a reply from the Balearic Ministry of Education, for which he has made an urgent request.
Meanwhile, the
Higher Education Inspectorate
, dependent on the Ministry of Isabel Celáa,
has refused to urge the Balearic Government to make Spanish a vehicular language in public schools
or, at least, that 25% of the classes be in this language.
"The current regulations do not indicate that the minimum proportion of Spanish in linguistic projects [...] should be 25%", denied Isabel García Sureda, director of the High Inspection of the Balearic Islands, to the PLIS claim,
ignoring three sentences of the Supreme Court.
Now PLIS requests that all these linguistic projects be modified.
And it warns the directors that they are the "owners" of the power to approve them and "those responsible for complying with the legal system
.
