The Seville judge who is investigating the macro-cause of alleged corruption around the public venture capital company of the Junta de Andalucía, Invercaria, is investigating Andalusian Government Councils of the stage as presidents of the socialists Manuel Chaves and José Antonio Griñán.

EL MUNDO has had access to the communication sent by the head of the Court of Instruction 16 of Seville,

Juan Gutiérrez Casillas

, to the Andalusian Government of the PP and Cs on April 29, in which he demands that it be delivered

"urgently"

and, as soon as possible, the minutes of the General Commission of Vice-counselors and the Governing Council of April 8, 2008 and May 22, 2012.

On the two dates that the investigating judge of the 'Invercaria case' scrutinizes, the socialist María Jesús Montero, spokesperson for the central government and Minister of Finance, was part of the Andalusian Government Councils as Minister of Health.

The Secretary General of the Andalusian PSOE, Susana Díaz, was also on the Governing Council on May 22, 2012, as Minister of the Presidency and Equality.

The minutes of the Governing Council that the judge is now demanding urgently dot the management of

two former

Andalusian

presidents

.

In April 2008, the president was Chaves and in May 2012, Griñán.

Both have been convicted, along with 17 other former high socialist positions, by the Seville Hearing in the ERE, the largest corruption case ever opened in Spain due to the volume defrauded -

679 million

euros - and the number of investigated -more than 200- in the different pieces of the macrocause.

The sentence is not final, since it is appealed before the Supreme Court.

Curiously, on October 14, another different court in Seville also claimed "the minutes of the Governing Council from 2005 to 2015, both included", corresponding to the period of Chaves, Griñan and Susana Díaz as chairmen of the Board.

In that case, as this newspaper has been reporting, the request was made by the judge investigating the Isofoton pufo, the Malaga photovoltaic company that closed after receiving

80,497,820.44 euros

of public funds from the Board.

With the latest judicial request for minutes from the Governing Council, the investigating judge in the

Invercaria case

tries to gather new evidence on the companies that allegedly benefited in an irregular way by the venture capital company.

Invercaria began to be judicially investigated in 2012, after controversial sound recordings came to light that exposed the arbitrary, million-dollar and uncontrolled investments of the Board's venture capital company, during the stage of the previous governments of the PSOE in Andalusia.

More than fifty investigated

Of the more than 30 pieces in which this macrocause of corruption was detached, one has already been tried and has a non-final conviction -for prevarication and embezzlement-, at least four have been archived, thirteen are waiting for it to be celebrated trial at the Seville Court and others are still under investigation.

There are more than fifty investigated.

Precisely the petition of Judge Gutiérrez Casillas regarding the minutes of the Governing Council of April 8, 2008 and May 22, 2012 refers to a case that is still under investigation: that referred to the company

TS Acabados Encuadernaciones SLU

.

This company, which was located in the Sevillian municipality of Alcalá de Guadaira, received grants, loans and guarantees from the Board for an amount of

5 million euros

, through IDEA, Invercaria and the Ministry of Economy.

For this reason, the judge, in addition to the minutes of the Governing Council and the Commission of Vice-counselors, requests from the Board

"all" documentation

related to the processing of ratification agreements of the governing council of the

IDEA Agency

of the Board on the aid and guarantees granted to TS Acabados Encuadernaciones SLU., as stated in the letter sent to the Board on October 29.

The IDEA Agency is the epicenter of several judicial investigations for alleged corruption.

In the ERE, this entity of the Board acted as

paying box

for the irregular aid that came out of the so-called

reptile fund

.

Many companies benefited from Invercaria also benefited from IDEA.

The society now in the crosshairs of the judge in the Invercaria case, TS Acabados Encuadernaciones SLU., Is especially striking, since to the large number of injections of public money that it received -5 million euros- it is added that it used a

false invoice

to justify before the Board an aid.

False invoice

The Andalusian Administration, in the stage of Susana Díaz as president, discovered in 2015 the alleged deception concocted eight years earlier with the false invoice and reported it to the Prosecutor's Office.

The problem is that it was too late to pursue the falsification of a commercial document allegedly committed by those responsible for the company, a crime that went unpunished because it

had

already

prescribed

, given the time that had elapsed.

TS Finishes Bindings received in 2008 a non-refundable grant from the IDEA Agency of just over

two million euros

and justified almost half, 900,000 euros, with the aforementioned false invoice whose real amount barely exceeded three thousand.

But this was not the last injection of public money.

Subsequently, the company received a loan from Invercaria for an amount of

525,000 euros

and somewhat later, in June 2012, the then Minister of Economy,

Antonio Ávila

, signed the concession of a "restructuring aid" that basically consisted of a guarantee to obtain a bank loan of up to two million.

The guarantee of two million euros received the final approval in the Governing Council of the Board held on May 22, 2012, whose minutes the investigating judge of the Invercaria case has now requested.

The legality of this aid in the form of a guarantee is in question in the framework of the investigation of the Invercaria case, since it has been detected that the file through which the granting of the guarantee was processed is

plagued with irregularities

.

Specifically, the investment in this company was carried out by Invercaria without making an investment proposal or business plan or, at least, without the provisions of said plan.
