The accident took place on Saturday in Luxeuil-les-Bains, in Haute-Saône.
A 2-year-old boy died and his grandmother was seriously injured after being hit by a car whose driver was blinded by the sun.
"An investigation was opened and entrusted to the gendarmerie", tweeted the public prosecutor Emmanuel Dupic, specifying that "the driver, a woman born in 1967 was negative for alcohol and drugs".
“According to witnesses and images, it was not driving fast.
She was dazzled because there was a beautiful sun, ”explained the magistrate.
"She did not see the grandmother and her grandson on a pedestrian crossing and hit them", hitting the child in the head.
The driver should be heard on Sunday "for manslaughter", according to Emmanuel Dupic.
A psychological unit "has been set up for the victim's family".
