The defense referred to his request to direct the decisive oath of the young man before a court of first instance, but it turned away from that, pointing out that no moral harm had occurred to the appellant, and demanding that the decisive oath be directed to the young man.

For its part, the Court of Appeal stated, in the merits of its ruling, that the proof of the criminal ruling and the judge to fine the woman 1000 dirhams with a stay of execution of the sentence for a period of three years for the accusation of insulting the young man in a way that violates his honor and esteem, by directing the phrase: “impolite and insolent”, and convicted Ruling women, and it became final.

The court affirmed its commitment to the sanction of the penal ruling, considering that as an evidence for the availability of an element of error on the woman's side, and refraining from discussing the element of error again, as long as there is sufficient availability to form her belief to settle the case without resorting to searching for other means of proof of the "decisive oath", and considering It became useless, before the conviction was proven, to uphold the appealed ruling, and to charge the woman fees and expenses.
